             7      LONG TITLE
             8      General Description:
             9          This concurrent resolution of the Legislature and the Governor urges local government,
             10      state government, and private landowner action.
             11      Highlighted Provisions:
             12          This resolution:
             13          .    urges local and state governmental entities and private landowners that own various
             14      portions of open space along the Jordan River between 12600 South and the
             15      Bangerter Highway to work together to assure that the land is preserved as open
             16      space.
             17      Special Clauses:
             18          None
             19     
             20      Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:
             21          WHEREAS, the people of Salt Lake County value open space;
             22          WHEREAS, one of the last remaining open spaces along the Jordan River is a 500 acre
             23      area, 370 acres of which is publicly owned, between 12600 South and the Bangerter Highway;
             24          WHEREAS, the majority of the area is undeveloped and includes wetlands, trails, and
             25      Native American ruins;
             26          WHEREAS, this land has persisted in almost its natural state, as one of the few
             27      stretches of the river which has not been hardened or straightened;


             28          WHEREAS, unlike most of the river corridor, large sections of open space exist on
             29      both sides of the river and are still frequented by deer and other wildlife;
             30          WHEREAS, this land is also home to all types of waterfowl and is an important
             31      migrational stop for a variety of birds;
             32          WHEREAS, protection of this valuable open space is crucial in order to ensure that a
             33      remnant of the historic Jordan River will remain;
             34          WHEREAS, H [ setting aside the land as open space, thus limiting human intrusion, ]
             34a      CREATING AND IMPLEMENTING A JOINT PLAN FOR JORDAN RIVER OPEN SPACE THAT h will
             35      provide the citizens of Utah with a natural oasis that is protected from the encroachments of
             36      development;
             37          WHEREAS, despite the fact that a large portion of the open space is publicly owned,
             38      ownership is spread across several local and state governmental agencies, which complicates
             39      efforts to move forward with a coordinated and specific purpose;
             40          WHEREAS, local governments, state entities, and private landowners should explore
             41      together the various means for establishing both the public and private portions of the land as
             42      open space for the benefit of the citizens of the state of Utah; and
             43          WHEREAS, by working together, these groups can formulate a process that will make
             44      more open space available for the citizens of the state H WHILE RECOGNIZING THE NEED TO
             44a      RESPECT AND ACCOMMODATE PUBLIC UTILITY RIGHTS OF WAY IMPACTED BY THE PROCESS
             44b      AND RESPECTING PROPERTY RIGHTS h :
             45          NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah, the
             46      Governor concurring therein, urge the city of Draper, the city of Riverton, Salt Lake County,
             47      and the state of Utah to develop an action plan for open space along the Jordan River between
             48      12600 South and the Bangerter Highway to work together to assure that the land is preserved as
             49      open space.
             50          BE IT FURTHER RESOLVED that a copy of this resolution be sent to Riverton City,
             51      Draper City, the Jordan Valley Water Conservancy District, the Central Utah Water
             52      Conservancy District, the Great Salt Lake Audubon Society, the Utah Reclamation Mitigation
             53      and Conservation Commission, the South Valley Trails Committee, the Salt Lake County Parks
             54      and Recreation Department, Utah Back Country Horsemen, the Natural Resources Forum, Salt
             55      Lake County, the Division of S FORESTRY, FIRE, AND s State Lands S [ , Fire and Forestry ] s , and
             55a      the Department of
             56      Transportation.
