             8      General Description:
             9          This bill appropriates an additional $88,000,000 to the State System of Public
             10      Education for the Interventions for Student Success Block Grant Program.
             11      Highlighted Provisions:
             12          This bill:
             13          .    appropriates $88,000,000 to the State Board of Education for the Interventions for
             14      Student Success Block Grant Program; and
             15          .    designates the appropriation as an ongoing appropriation.
             16      Monies Appropriated in this Bill:
             17          This bill appropriates:
             18          .    $88,000,000 to the State Board of Education for the fiscal year beginning July 1,
             19      2004, as an ongoing appropriation, for the Interventions for Student Success Block
             20      Grant Program.
             21      Other Special Clauses:
             22          This bill takes effect on July 1, 2004.
             23      Utah Code Sections Affected:

             27      Be it enacted by the Legislature of the state of Utah:


             28          Section 1. Section 53A-17a-123.5 is amended to read:
             29           53A-17a-123.5. Interventions for Student Success Block Grant Program -- State
             30      contribution.
             31          (1) (a) The Interventions for Student Success Block Grant Program shall consist of:
             32          (i) the money appropriated for the Interventions for Student Success Block Grant
             33      Program in Section 53A-17a-104 ; and
             34          (ii) subject to future budget constraints, there is appropriated, as an ongoing
             35      appropriation, to the State Board of Education for the fiscal year beginning July 1, 2004,
             36      $88,000,000 for the Interventions for Student Success Block Grant Program.
             37          [(1)] (b) The State Board of Education shall distribute money appropriated for the
             38      Interventions for Student Success Block Grant Program in [Section 53A-17a-104 ] Subsection
             39      (1)(a) to school districts and charter schools according to a formula adopted by the board, after
             40      consultation with school districts and charter schools, that allocates the funding in a fair and
             41      equitable manner.
             42          (2) Schools districts and charter schools shall use Interventions for Student Success
             43      Block Grant monies to improve student academic success, with priority given to interventions
             44      on behalf of students not performing to standards as determined by U-PASS test results.
             45          (3) (a) Each school district shall develop a plan for the expenditure of Interventions for
             46      Student Success Block Grant monies.
             47          (b) The plan:
             48          (i) shall specify anticipated results; and
             49          (ii) may include continuing existing programs to improve students' academic success
             50      for which funds were appropriated before the establishment of the block grant.
             51          (c) The local school board shall approve the plan for the expenditure of the block grant
             52      monies in an open public meeting before the monies are spent.
             53          Section 2. Effective date.
             54          This bill takes effect on July 1, 2004.
