             6      LONG TITLE
             7      General Description:
             8          This bill amends the brucellosis vaccination provision for livestock.
             9      Highlighted Provisions:
             10          This bill:
             11          .    specifies certain cattle that are required to be vaccinated for brucellosis.
             12      Monies Appropriated in this Bill:
             13          None
             14      Other Special Clauses:
             15          None
             16      Utah Code Sections Affected:
             17      AMENDS:
             18          4-31-16.5, as enacted by Chapter 290, Laws of Utah 1999

             20      Be it enacted by the Legislature of the state of Utah:
             21          Section 1. Section 4-31-16.5 is amended to read:
             22           4-31-16.5. Brucellosis -- Vaccination required for certain cattle -- Testing
             23      required to import certain cattle.
             24          (1) As used in this section,"test-eligible" has the meaning defined in 9 C.F.R. Sec.
             25      78.1.



             26          (2) (a) Instate origin replacement cattle that are kept for breeding stock must be official
             27      calfhood vaccinated for brucellosis.
             28          (b) Female cattle from within the state that are not kept for breeding stock will not be
             29      required to be vaccinated.
             30          (c) For purposes of this Subsection (2), the department may make rules in accordance
             31      with Title 63, Chapter 46a, Utah Administrative Rulemaking Act, governing noneligible
             32      brucellosis tattoos and may accept brucellosis vaccination record forms as evidence that
             33      brucellosis vaccinations were performed.
             34          [(2) Female] (3) All female beef-breed cattle [within or] imported into the state are
             35      [not] required to be official calfhood vaccinated for brucellosis[.] except female cattle:
             36          (a) less than four months of age;
             37          (b) going directly to slaughter;
             38          (c) going to a qualified feedlot; or
             39          (d) going to an approved auction to be vaccinated on arrival or designated for slaughter
             40      only.
             41          [(3)] (4) (a) Test-eligible cattle imported from states designated as brucellosis-free
             42      under 9 C.F.R. Sec. 78.43, that are acquired directly from the farm of origin are not required to
             43      be tested for brucellosis before movement into the state.
             44          (b) Test-eligible cattle imported from states designated as brucellosis-free under 9
             45      C.F.R. Sec. 78.43, that are acquired through trading channels must test negative for brucellosis
             46      within 30 days before movement into the state.
             47          [(4)] (5) Test-eligible cattle imported from states that have not been designated as
             48      brucellosis-free under 9 C.F.R. Sec. 78.43, must test negative for brucellosis within 30 days
             49      before movement into the state.
             50          (6) The department may investigate situations where fees for brucellosis vaccinations
             51      are considered to be excessive.
             52          (7) The department may make rules in accordance with Title 63, Chapter 46a, Utah
             53      Administrative Rulemaking Act, for beef-breed cattle that are acquired for specialized breeding
             54      purposes, and may exempt those cattle from brucellosis vaccination requirements.
             55          [(5)] (8) The department shall make rules in accordance with Title 63, Chapter 46a,
             56      Utah Administrative Rulemaking Act, to implement this section.
