             7      LONG TITLE
             8      General Description:
             9          This bill creates a grant program to minimize out-of-pocket expenses of licensed
             10      teachers to meet federal highly qualified teacher standards.
             11      Highlighted Provisions:
             12          This bill:
             13          .    directs the State Board of Education to give grants to school districts and charter
             14      schools to pay for costs directly related to enabling certain licensed teachers to meet
             15      federal highly qualified teacher standards;
             16          .    requires school districts and charter schools to provide matching funds to qualify for
             17      a grant;
             18          .    specifies how grant monies may be used;
             19          .    requires the State Board of Education to make rules for the administration of the
             20      grant program; and
             21          .    repeals the grant program on July 1, 2007.
             22      Monies Appropriated in this Bill:
             23          This bill appropriates $1,500,000 from the Uniform School Fund for fiscal year
             24      2004-05 only, to the State Board of Education.
             25      Other Special Clauses:
             26          This bill takes effect on July 1, 2004.

             33      Be it enacted by the Legislature of the state of Utah:
             34          Section 1. Section 53A-6-111 is enacted to read:
             35          53A-6-111. Grants for licensed teachers to meet federal highly qualified teacher
             36      standards.
             37          (1) As used in this section, "licensed teacher" means a teacher who holds:
             38          (a) a level 1, level 2, or level 3 license; and
             39          (b) the endorsements required by board rule for the teacher's teaching assignments.
             40          (2) A grant program is created to minimize out-of-pocket expenses of licensed teachers
             41      to meet federal highly qualified teacher standards as defined in 20 U.S.C. Sec. 7801.
             42          (3) The State Board of Education shall give grants to school districts and charter
             43      schools for the purpose stated in Subsection (2) from monies appropriated by the Legislature
             44      for that purpose.
             45          (4) To receive a grant, a school district or charter school shall provide matching funds
             46      to minimize out-of-pocket expenses of licensed teachers to meet federal highly qualified
             47      teacher standards in an amount equal to the grant.
             48          (5) Grant monies and matching funds shall be used to pay for costs of school districts,
             49      charter schools, or licensed teachers that are directly related to enabling licensed teachers to
             50      meet federal highly qualified teacher standards, including:
             51          (a) college or university tuition and fees;
             52          (b) costs of instructors and supplies for courses and workshops offered by school
             53      districts; and
             54          (c) fees for tests that, if the licensed teacher passes, the teacher meets federal highly
             55      qualified teacher standards.
             56          (6) The State Board of Education shall distribute money appropriated by the
             57      Legislature to pay for costs directly related to enabling licensed teachers to meet federal highly
             58      qualified teacher standards to school districts and charter schools in accordance with:


             59          (a) Subsection (4); and
             60          (b) a formula adopted by the board, after consultation with school districts and charter
             61      schools, that allocates the funding in a fair and equitable manner.
             62          (7) The State Board of Education shall make rules in accordance with Title 63, Chapter
             63      46a, Utah Administrative Rulemaking Act, to administer this section.
             64          Section 2. Section 63-55b-153 is amended to read:
             65           63-55b-153. Repeal dates -- Titles 53, 53A, and 53B.
             66          (1) Subsection 53-3-205 (9)(a)(i)(D) is repealed July 1, 2007.
             67          (2) Subsection 53-3-804 (2)(g) is repealed July 1, 2007.
             68          (3) Title 53, Chapter 12, State Olympic Public Safety Command Act, is repealed July
             69      1, 2003.
             70          (4) Section 53A-1-403.5 is repealed July 1, 2007.
             71          (5) Section 53A-6-111 is repealed July 1, 2007.
             72          [(5)] (6) Section 53B-8-104.5 is repealed July 1, 2009.
             73          Section 3. Appropriation.
             74          (1) There is appropriated $1,500,000 from the Uniform School Fund for fiscal year
             75      2004-05 only, to the State Board of Education to distribute to school districts and charter
             76      schools to pay for costs directly related to enabling licensed teachers to meet federal highly
             77      qualified teacher standards.
             78          (2) The money appropriated in Subsection (1):
             79          (a) shall be used as provided in Section 53A-6-111; and
             80          (b) is nonlapsing.
             81          Section 4. Effective date.
             82          This bill takes effect on July 1, 2004.
