             7      General Description:
             8          This bill increases the penalty for theft of mail valued at less than $300.
             9      Highlighted Provisions:
             10          This bill:
             11          .    increases the penalty for theft of mail with a value less than $300, or with value that
             12      cannot be ascertained, from a class B to a class A misdemeanor.
             13      Monies Appropriated in this Bill:
             14          None
             15      Other Special Clauses:

             17      Utah Code Sections Affected:
             18      AMENDS:
             19          76-6-1003, as enacted by Chapter 87, Laws of Utah 1998

             21      Be it enacted by the Legislature of the state of Utah:
             22          Section 1. Section 76-6-1003 is amended to read:
             23           76-6-1003. Mail theft -- Penalties.
             24          (1) A person commits the crime of mail theft if the person:
             25          (a) knowingly, and with the intent to deprive another:
             26          (i) takes, destroys, hides, or embezzles mail; or
             27          (ii) obtains any mail by fraud or deception; or


             28          (b) buys, receives, conceals, or possesses mail and knows or reasonably should have
             29      known that the mail was unlawfully taken or obtained.
             30          (2) Mail theft is a:
             31          (a) felony of the second degree if the value of the mail is or exceeds $5,000;
             32          (b) felony of the third degree if the value of the mail is or exceeds $1,000, but is less
             33      than $5,000 in value; and
             34          (c) class A misdemeanor if the value of the mail is [or exceeds $300, but is] less than
             35      $1,000 in value[; and] or the value cannot be ascertained.
             36          [(d) class B misdemeanor if the value of the mail is less than $300 in value or the value
             37      cannot be ascertained.]
