             6      LONG TITLE
             7      General Description:
             8          This bill creates the System of Care Pilot Program to be administered by the
             9      Department of Human Services.
             10      Highlighted Provisions:
             11          This bill:
             12          .    provides definitions;
             13          .    provides wrap around services to 25 children and their families in select counties
             14      throughout the state;
             15          .    requires the Division of Child and Family Services and the Division of Youth
             16      Corrections to pay for certain mental health costs associated with the wrap around
             17      services;
             18          .    requires the Department of Human Services, the juvenile court, and school district
             19      personnel who are involved to participate in the development and implementation
             20      of the wrap around service plan;
             21          .    requires the mental health centers involved to work cooperatively with the
             22      Department of Human Services, the juvenile court, school districts, and local family
             23      organizations to implement a local assessment team to monitor the wrap around
             24      service plan; and
             25          .    requires participating families to complete a family team survey.

             34      Be it enacted by the Legislature of the state of Utah:
             35          Section 1. Section 62A-4a-312 is enacted to read:
             36          62A-4a-312. System of Care Pilot Program.
             37          (1) There is established the System of Care Pilot Program to be administered by the
             38      Division of Child and Family Services beginning on July 1, 2004 and ending on June 30, 2005.
             39          (2) As used in this section:
             40          (a) "Family facilitator" means a family member who has had experience in the family
             41      member's own family with a child with a serious emotional disturbance and has been trained to
             42      support care-givers and youth who have a serious emotional disturbance. The family
             43      facilitator:
             44          (i) ensures that the family voice is heard at:
             45          (A) family team meetings; and
             46          (B) public agency meetings;
             47          (ii) assists the parents and family members to partner with agencies; and
             48          (iii) coordinates family team meetings.
             49          (b) "Family member" means a parent or family member who has in the past or is
             50      currently acting as care-giver to a child with a serious emotional disturbance.
             51          (c) (i) "Family team" means a team composed of individuals chosen by the family
             52      which may include:
             53          (A) the youth or child care-giver;
             54          (B) a family facilitator;
             55          (C) an agency partner; or
             56          (D) a support person from the community.
             57          (ii) The family team shall meet regularly to develop and implement service plans and
             58      to develop and implement crisis and safety plans as needed.



             59          (iii) The goals of the family team are to help families understand and negotiate the
             60      system of care, including agency services and community resources.
             61          (d) "Family team survey" means a tool that monitors:
             62          (i) agency participation;
             63          (ii) informal and formal supports;
             64          (iii) services delivered in a manner that meet the cultural needs of the family; and
             65          (iv) family satisfaction.
             66          (e) "Wrap around service plan" means a single individualized service plan that can be
             67      understood by the family and, when appropriate, the children, that coordinates all the services
             68      provided and legal mandates that agencies are required to complete for funding or legislative
             69      compliance.
             70          (f) "Wrap around services" means a family centered, team-based, coordinated service
             71      plan that focuses on the strengths, needs, and cultures of the child and family using formal,
             72      informal, and natural supports to develop and implement the service plan with the child and
             73      family.
             74          (3) (a) Under the pilot program, 25 children and their families shall receive wrap
             75      around services from the mental health agency responsible for services in the county where the
             76      children and their families reside. The program shall serve the following number of children in
             77      the following counties:
             78          (i) five children from Washington County;
             79          (ii) five children from Iron County;
             80          (iii) five children from Beaver, Kane, and Piute Counties combined; and
             81          (iv) ten children from Carbon, Emery, and Garfield Counties combined.
             82          (b) The mental health agency will use a family facilitator to work with a family to
             83      coordinate across agencies to develop and implement a service plan that provides community
             84      based services or out-of-home placements that meet the mental health needs of the child and
             85      provide for community safety.
             86          (4) (a) The Division of Child and Family Services and the Division of Youth
             87      Corrections shall pay the mental health center a mutually agreed upon daily rate for the wrap
             88      around services.
             89          (b) The daily rate shall be paid monthly and shall cover the complete cost of care for


             90      the child.
             91          (c) The wrap around services purchased at the daily rate must meet the child's clinical
             92      needs and provide for community safety.
             93          (5) The Department of Human Services, the juvenile court, and school district
             94      personnel directly involved in service delivery to the child and parent or other family members
             95      who may be direct care-givers for the child, shall participate in the wrap around service plan
             96      development and service implementation.
             97          (6) The mental health centers involved shall work cooperatively with the Department
             98      of Human Services, the juvenile court, school districts, and local family organizations to
             99      implement a local assessment team to monitor the wrap around service plan to ensure the
             100      following are being met by the wrap around service plan:
             101          (a) that the child's clinical needs are being met;
             102          (b) that community safety is a primary consideration;
             103          (c) that legislative and funding mandates are being met; and
             104          (d) that the Department of Human Services, the juvenile court, and school district
             105      personnel are participating in the planning and delivery of wrap around services.
             106          (7) Each family involved in the program will complete a family team survey to
             107      determine whether they feel their family's needs are being met by the wrap around team and
             108      wrap around service plan.
