             7      LONG TITLE
             8      General Description:
             9          This resolution modifies provisions governing rules resolutions reviewed by the House
             10      Rules Committee.
             11      Highlighted Provisions:
             12          This resolution:
             13          .    modifies existing language governing the House Rules Committee by allowing rules
             14      resolutions reviewed and approved by the committee to be reported directly to the
             15      House if the committee chooses to do so.
             16      Special Clauses:
             17          This resolution provides an immediate effective date.

             22      Be it resolved by the House of Representatives of the state of Utah:
             23          Section 1. HR-24.01 is amended to read:
             24           HR-24.01. House Rules Committee.
             25          (1) All legislation introduced shall be submitted to the House Rules Committee.
             26          (2) (a) The House Rules Committee has all the powers, functions, and duties of a
             27      standing committee when it:


             28          (i) prepares the House Rules and Joint Rules and presents them to the House before
             29      adjournment on the second day of each annual general session; or
             30          (ii) reviews all House Rules or Joint Rules resolutions.
             31          (b) [Rules] Any rules resolutions reviewed and approved by the House Rules
             32      Committee [shall] may be reported directly to the House for its approval, amendment, or
             33      disapproval.
             34          (c) Notwithstanding Subsection (6), when meeting as a standing committee under this
             35      Subsection (2), persons other than committee members may make comments and
             36      recommendations at the discretion of the chair.
             37          (3) For all legislation not specified in Subsection (2) that is referred to the House Rules
             38      Committee, the committee shall:
             39          (a) (i) examine each bill for proper form, including fiscal note and interim committee
             40      note, if any, and, when in proper form, order the bills printed; and
             41          (ii) in extraordinary circumstances, recommend to the House that a bill be printed
             42      without a fiscal note; and
             43          (b) either:
             44          (i) refer bills to the House with a recommendation:
             45          (A) that the legislation be referred to a standing committee for consideration; or
             46          (B) that the legislation be read the second time and placed on the third reading
             47      calendar; or
             48          (ii) hold the bill.
             49          (4) In carrying out its functions and responsibilities under Subsection (3), the House
             50      Rules Committee may not:
             51          (a) table a bill without the written consent of the sponsor;
             52          (b) report out any bill that has been tabled by a standing committee;
             53          (c) amend a bill without the written consent of the sponsor;
             54          (d) substitute a bill without the written consent of the sponsor; or
             55          (e) sponsor a bill, except for the revisor's bill.
             56          (5) When this committee is carrying out the functions and responsibilities of
             57      Subsection (3), this committee shall:
             58          (a) during a legislative session, give notice of its meetings by either:


             59          (i) providing oral notice from the floor of the time and place of its next meeting; or
             60          (ii) when oral notice is impractical, post written notice of its next meeting;
             61          (b) when the Legislature is not in session, post a notice of meeting at least 24 hours
             62      before the meeting convenes;
             63          (c) have as its agenda all bills in its possession for assignment to committee; and
             64          (d) prepare minutes that include a record, by individual legislator, of votes taken.
             65          (6) Anyone may attend a meeting of the rules committee, but comments and discussion
             66      are limited to members of the committee.
             67          Section 2. Effective date.
             68          This resolution takes effect upon approval by a constitutional majority vote of all
             69      members of the House of Representatives.
