             7      LONG TITLE
             8      General Description:
             9          This bill modifies the qualifications of the Assistant Adjutant General and the duties of
             10      the personnel officer.
             11      Highlighted Provisions:
             12          This bill:
             13          .    allows the Assistant Adjutant General to S [ be ] APPOINT s a former federally recognized
             14      commissioned officer S AS THE PERSONNEL OFFICER s ; and
             15          .    removes from the personnel officer's duties the obligation of serving as both the
             16      state recruiting officer and the state public relations officer.

             25      Be it enacted by the Legislature of the state of Utah:
             26          Section 1. Section 39-1-18 is amended to read:
             27           39-1-18. Assistant adjutant general for the army -- Assistant adjutant general for

     air -- Officer for permanent duty as personnel officer.
             29          (1) There is [hereby] authorized an assistant adjutant general for the army and an
             30      assistant adjutant general for air.
             31          (a) The adjutant general with the approval of the governor may detail the assistant
             32      adjutant general for the army or the assistant adjutant general for air for permanent duty at S [ his ]

             33      office. [He]
             34          (b) The assistant adjutant general for the army or assistant adjutant general for air shall
             35      be a federally recognized commissioned officer S [ , or former federally recognized commissioned
             36      officer,

of the Utah National Guard with not less than five years military service in the armed
             37      forces of the state of Utah or of the United States, at least three of which shall have been
             38      commissioned in the National Guard of Utah, and who shall have reached the grade of field
             39      officer. S [ He ] THE OFFICER s shall:
             40          (i) hold office at the pleasure of the adjutant general[. He shall]; and
             41          (ii) devote all of his time during office hours of the military department to the duties of
             42      [his] the office.
             43          (2) The adjutant general, with the approval of the governor, may detail one officer of
             44      the Utah National Guard for permanent duty as the personnel officer. [He]
             45          (a) The officer shall be a federally recognized commissioned officer S , OR FORMER
             45a      FEDERALLY RECOGNIZED COMMISSIONED OFFICER, s of the Utah
             46      National Guard with not less than three years military service in the armed forces of the state of
             47      Utah or of the United States, one of which shall have been commissioned in the National
             48      Guard of Utah. [He]
             49          (b) The officer shall hold office at the pleasure of the adjutant general.
             50          (c) The duties of the personnel officer shall be [such duties] as the adjutant general
             51      may direct, to include the normal duty of the staff G-1 [and G-2. He shall function as a state
             52      recruiting officer and also as a state public relations officer and].
             53          (d) The officer shall devote all of his time during the office hours of the military
             54      department to the duties of [his] the office.
