                  LONG TITLE
                  General Description:
                      This bill amends age requirement provisions for obtaining certain fishing and hunting
                  licenses.
                  Highlighted Provisions:
                      This bill:
                      .    allows 11-year-old persons to obtain a combination license to hunt small game and
                  fish if their 12th birthday falls within the calendar year for which the license is issued;
                      .    allows 11-year-old persons to obtain a cougar or bear hunting permit if their 12th
                  birthday falls within the calendar year for which the hunting permit is issued;
                      .    allows 11-year-old persons to obtain a small game hunting license if their 12th
                  birthday falls within the calendar year for which the license is issued;
                      .    allows a person 12 years of age or older, and in certain circumstances, 11-year-old
                  persons, to obtain a turkey hunting permit; and
                      .    provides that $1 of each resident's turkey hunting fee be used for the hunters'
                  education program.

                      This bill provides a coordination clause.

                  ENACTS:
                      23-19-22.6, Utah Code Annotated 1953
                 
                  Be it enacted by the Legislature of the state of Utah:
                      Section 1. Section 23-19-17 is amended to read:
                       23-19-17. Resident fishing and hunting license -- Use of fee.
                      (1) A resident 12 years of age or older, upon payment of the fee prescribed by the
                  Wildlife Board, may receive a combination license to fish and to hunt for small game as provided
                  in the rules of the Wildlife Board.
                      (2) A person 11 years of age, upon payment of the fee, may obtain a license to fish and to
                  hunt small game if that person's 12th birthday falls within the calendar year in which the license is
                  issued.
                      [(2)] (3) One dollar of the combination license fee shall be used for the hunter education
                  program in any of the following:
                      (a) instructor and student training;
                      (b) assisting local organizations with development;
                      (c) maintenance of existing facilities; or
                      (d) operation and maintenance of the hunter education program.
                      [(3)] (4) (a) Fifty cents of the combination license fee shall be used for the upland game
                  program as follows:
                      (i) to acquire pen-raised birds; or
                      (ii) to capture and transplant upland game species.
                      (b) The combination license fee revenue designated for the upland game program by
                  Subsection [(3)] (4)(a) is in addition to any combination license fee revenue that may be used for
                  the upland game program as provided by Sections 23-19-43 and 23-19-47 .

                      Section 2. Section 23-19-22.5 is amended to read:
                       23-19-22.5. Cougar or bear hunting permit.
                      (1) A person 12 years of age or older, upon [paying] payment of the fee prescribed by the
                  Wildlife Board, may receive a permit to take cougar or bear as provided by rules of the Wildlife
                  Board.
                      (2) A person 11 years of age, upon payment of the fee, may obtain a permit to hunt
                  cougar or bear if that persons's 12th birthday falls within the calendar year in which the permit is
                  issued.
                      [(2)] (3) One dollar of each cougar or bear permit fee collected from a resident shall be
                  used for the hunter education program.
                      Section 3. Section 23-19-22.6 is enacted to read:
                      23-19-22.6. Turkey hunting permit.
                      (1) A person 12 years of age or older, upon payment of the fee, may receive a permit to
                  take turkey as provided by rules of the Wildlife Board.
                      (2) A person 11 years of age, upon payment of the fee, may obtain a permit to hunt
                  turkey if that person's 12th birthday falls within the calendar year in which the permit is issued.
                      (3) One dollar of each turkey permit fee collected from a resident shall be used for the
                  hunter education program.
                      Section 4. Section 23-19-25 is amended to read:
                       23-19-25. Resident small game hunting license -- Use of fee.
                      (1) A resident under the age of 14 years and 12 years of age or older, upon payment of
                  the fee prescribed by the Wildlife Board, may receive a license to hunt small game.
                      (2) A person 11 years of age, upon payment of the fee, may obtain a license to hunt small
                  game if that person's 12th birthday falls within the calendar year in which the license is issued.
                      [(2)] (3) One dollar of the small game hunting license fee shall be used for the hunter
                  education program.
                      [(3)] (4) (a) Fifty cents of the small game hunting license fee shall be used for the upland
                  game program as follows:

                      (i) to acquire pen-raised birds; or
                      (ii) to capture and transplant upland game species.
                      (b) The small game license fee revenue designated for the upland game program by
                  Subsection [(3)] (4)(a) is in addition to any small game license fee revenue that may be used for
                  the upland game program as provided by Sections 23-19-43 and 23-19-47 .
                      Section 5. Section 23-19-26 is amended to read:
                       23-19-26. Nonresident small game hunting license -- Use of fee.
                      (1) A nonresident 12 years of age or older, upon payment of the fee prescribed by the
                  Wildlife Board, may receive a license to hunt small game.
                      (2) A nonresident 11 years of age, upon payment of the fee, may obtain a license to hunt
                  small game if that person's 12th birthday falls within the calendar year in which the license is
                  issued.
                      [(2)] (3) (a) Fifty cents of the small game hunting license fee shall be used for the upland
                  game program as follows:
                      (i) to acquire pen-raised birds; or
                      (ii) to capture and transplant upland game species.
                      (b) The small game license fee revenue designated for the upland game program by
                  Subsection [(2)] (3)(a) is in addition to any small game license fee revenue that may be used for
                  the upland game program as provided by Sections 23-19-43 and 23-19-47 .
                      Section 6. Coordinating S.B. 138 with H.B. 235.
                      If this S.B. 138 and H.B. 235, Turkey Hunting Permits, both pass, it is the intent of the
                  Legislature that the amendments made to Section 23-19-22.6 in this bill shall supercede the
                  amendments made to Section 23-19-22.6 in H. B. 235.
