             7      LONG TITLE
             8      General Description:
             9          This bill modifies the Motor Vehicle Code by restricting school bus drivers' use of
             10      wireless telephones.
             11      Highlighted Provisions:
             12          This bill:
             13          .    prohibits school bus drivers from using wireless telephones while operating a school
             14      bus, with exceptions;
             15          .    permits school bus drivers to use a wireless telephone in case of a medical
             16      emergency, a safety hazard, or a criminal activity; and
             17          .    provides penalties.
             18      Monies Appropriated in this Bill:
             19          None
             20      Other Special Clauses:
             21          None
             22      Utah Code Sections Affected:
             23      ENACTS:
             24          41-6-115.5, Utah Code Annotated 1953
             25     
             26      Be it enacted by the Legislature of the state of Utah:
             27          Section 1. Section 41-6-115.5 is enacted to read:


             28          41-6-115.5. Use of wireless telephones by school bus drivers prohibited --
             29      Exceptions -- Penalties.
             30          (1) Except as provided under Subsection (2), a school bus driver may not use a wireless
             31      telephone while operating a school bus.
             32          (2) Subsection (1) does not prohibit a school bus driver from using a wireless
             33      telephone:
             34          (a) during a medical emergency;
             35          (b) when reporting a safety hazard or requesting assistance relating to a safety hazard;
             36      S [ or ] s
             37          (c) when reporting a criminal activity or requesting assistance relating to a criminal
             38      activity S [ . ] ;
             38a      (d) WHEN COMMUNICATING WITH THE STUDENTS' PARENTS; OR(E) WHEN COMMUNICATING WITH
             38b      THE DRIVER'S SCHOOL OFFICIALS. s
             39          (3) A person who violates this section is guilty of an infraction and shall be fined $100.
