Rep. Morley called the meeting to order at 4:13 p.m.

MOTION:    Rep. D. Clark moved to approve the minutes of the February 6, 2004 meeting.
        The motion passed unanimously, with Rep. Bryson, Rep. Dunnigan, Rep. Ferry,         and Rep. Hansen absent for the vote.

S.B. 88    Uniform Building Standards Act - Manufactured Housing Amendments (Sen. L. Hillyard)

Rep. Adams explained the bill, assisted by Dale Zabriskie, Utah Manufactured Housing Association.

Spoke for the bill:    Craig Jackson, Director, Division of Occupational and Professional             Licensing

MOTION:    Rep. Buttars moved to pass the bill out favorably. The motion passed              unanimously, with Rep. Bryson absent for the vote.

S.B. 111    Mechanics' Liens Amendments (Sen. S. Jenkins)

Sen. Jenkins explained the bill.

MOTION:    Rep. Adams moved to pass the bill out favorably. The motion passed              unanimously, with Rep. Bryson absent for the vote.

MOTION:    Rep. Hansen moved that 2nd Substitute S.B.111 be placed on the consent         calendar. The motion passed unanimously, with Rep. Bryson absent for the vote.

MOTION:    Rep. D. Clark moved that the committee saunter for 5 minutes. The motion         passed unanimously, with Rep. Bryson absent for the vote.

Rep. Morley reconvened the meeting at 4:35 p.m.

H.B. 160    Mortgage Act Amendments (Rep. W. Harper)

MOTION:    Rep. Buttars moved to delete in title and body H.B. 160 and replace it with 2nd         Substitute H.B. 160. The motion passed unanimously, with Rep. Bryson, Rep.         Dunnigan, and Rep. Ferry absent for the vote.

MOTION:    Rep. Adams moved to proceed to the next item on the agenda.

SUBSTITUTE
MOTION:    Rep. Hansen moved to pass the bill out favorably. The motion failed, with Rep.         Bryson, Rep. D. Clark, Rep. Duckworth, and Rep. Hansen voting in favor.

The original motion to proceed to the next item on the agenda passed, with Rep. Bryson, Rep. Dunnigan, and Rep Ferry voting in opposition.

S.B. 129    Community Associations (Sen. M. Waddoups)

Rep. Dunnigan moved to amend the bill as follows:


1.    Page 8, Line 244 through Page 9, Line 247 :    

             244          (1) An encumbrancer holding a lien on a lot may pay any unpaid assessment due with
             245      respect to the
[[   unit   ]]        lot       .

             246          (2) Upon a payment described in Subsection (1), the encumbrancer has a lien on the
             247     
[[   unit   ]]        lot       for the amounts paid.


The motion to amend passed unanimously.

Sen. Waddoups explained the bill.

H.B. 122    Private Investigator Amendments (Rep. M. Dayton)
                            
Rep. Dayton explained the bill, assisted by John Tinsley, owner, Tinsley Private Investigators.

MOTION:    Rep. S. Clark moved to pass the bill out favorably.

SUBSTITUTE
MOTION:    Rep. D. Clark moved to pass the bill out favorably with the following         amendments:

1.    Page 1, Lines 15 through 16 :    

             15          .    provides that an apprentice private investigator may not directly obtain protected
             16      information from the
  Utah State Tax Commission       Motor Vehicle Division or Driver License Division within the


2.    Page 6, Lines 176 through 178 :    

             176          (C) obtain information from the
  Utah State Tax Commission       Motor Vehicle Division or Driver License Division

             177      within the Department of Public Safety, except the apprentice may utilize such information for


             178      a legitimate business need under the direct supervision of a licensed agency.
The motion to amend and pass the bill out favorably passed unanimously, with Rep. Bryson absent for the vote.

H.B. 221    Use of Credit Information for Insurance (Rep. P. Wallace)

    This bill was not considered.

MOTION:    Rep. Kiser moved to adjourn the meeting.
