Vice Chair Newbold called the meeting to order at 8:05 a.m. and welcomed committee members.

H.B. 65    Tuition Waiver for Purple Heart Recipients (Rep. G. Hughes
)

Rep. Hughes said the bill allows purple heart recipients to receive a tuition waiver at state institutions of higher education. Rep. Hutchings responded to committee members' questions.

MOTION:    Rep. Hughes moved to amend the bill as follows:

1.    Page 1, Lines 14 through 15 :

MOTION:    Rep.Holdaway moved to pass the bill out favorably.

The motion passed with Rep. Dougall, Rep. Ferrin, and Rep. Pace voting in opposition.


H.B. 46    Appropriation for School Districts Impacted by Fee Waivers (Rep. L. Shurtliff)


Rep. Shurtliff explained the bill allows the State Board of Education to distribute funds to school districts impacted by fee waivers. Rep. Shurtliff introduced Larry Latham and Bruce Penland, Ogden District, who discussed the impacts of fee waivers.

MOTION:    Rep. Hughes moved to amend the bill as follows:

Page 2, Lines 42 through 43:    (iv) The waiver provisions in Subsections (2) and (3) apply to all other fees, deposits, and charges made in the secondary schools.

  (v) In accordance with Title 63, Chapter 46a, Utah Administrative Rulemaking Act, the State Board of Education shall make rules:

    (A) requiring a student applying for a fee waiver to provide documentation to the school that verifies the student's eligibility to receive the waiver; and
    (B) specifying the acceptable forms of documentation for the requirement under Subsection (1)(b)(v)(A).

SUBSTITUTE
MOTION:    Rep. Dougall moved to amend the bill by adopting Rep.Hughes' amendment with
    the following modifications:

1.    After "(A) requiring" insert "the parent or guardian of" and after "documentation"
    insert "and certification"

The substitute motion passed with Rep. King absent for the vote.

MOTION:    Rep. Ferrin moved to amend the amendment previously adopted by deleting
    "verifies"and inserting "verify".

The motion passed unanimously with Rep. King absent for the vote.

MOTION:    Rep. Hogue moved to pass the bill out favorably.

The motion passed with Rep. Christensen, Rep. Dougall, and Rep. Newbold voting in opposition. Rep. King was absent for the vote.

MOTION:    Rep. Holdaway moved to adjourn. The motion passed unanimously with Rep.
    King absent for the vote.
