Chair Murray called the meeting to order at 3:25 p.m.

MOTION: Rep. Bush moved to approve the minutes of January 21, 2004. The motion passed unanimously with Reps. Bird, Dougall, Dunnigan, McCartney, and Lockheart absent for the vote.

HB0208    Regulation of Motorized Scooters (Rep. B. Dee)

    Rep. Dee explained the bill to the committee. Wayne Jones, Independent Auto Dealer Association spoke in favor of the bill.

MOTION:    Rep. Bush moved to approve the amendments of the bill as follows:

1.    Page 1, Line 19 :

    .    exempts a person with disability from certain use restrictions for a personal motorized mobility device and a motor assisted scooter; and  



2.    Page 9, Lines 257 through 259 :    

             257          [(5)] (6) Except where posted or prohibited by rule or local ordinance, a motor assisted
             258      scooter is considered a nonmotorized vehicle if it is being used with the motor turned off.
             259     
      (7)    The provisions of this section do not apply to a motorized scooter, motorized wheelchair, or other device being used for mobility by a person with a disability as defined by and covered under the Americans with Disabilities Act of 1990, 42 U.S.C. Sec. 12102.

The motion passed with Rep. Dunnigan absent for the vote.

MOTION:    Rep. Dougall moved to amend the bill as follows: 1. Line 58 after visual insert "and audio" Motion failed with Rep. Dougall voting favorably, Reps. Bird, Bush, Clark, Frank, King, Lockhart, Morgan, Kiser, and Murray voting against, and Reps. McCartney and Dunnigan absent for the vote.

MOTION:    Rep. King moved to pass the bill out favorably. The motion failed with Reps. Murray, King and Clark voting favorably, Reps. Bird, Bush, Dougall, Frank, Lockhart, Morgan, and Kiser voting against, and Reps. Dunnigan and McCartney absent for the vote.

SB0077    Expansion of New Motor Vehicle Warranties (Sen. P. Arent) (Rep. S. Allen)
    
    Sen. Arent explained the bill to the committee and presented a video and a handout. Francine Giani, Director of the Utah Division of Consumer Protection assisted with the explanation of the bill. Wayne Jones, Independent Auto Dealer Association spoke for the bill.

MOTION:    Rep. Morgan moved to pass the bill out favorably. The motion passed unanimously with Rep. McCartney absent for the vote.

SB0011    Guidelines for Local Matching Dollars for Transportation Projects (Sen. C. Walker) (Rep. R. Lockhart)

    Sen. Walker explained the bill to the committee. Jan Wells, State Transportation Commission and John Njord, Utah Department of Transportation spoke to the bill.

MOTION:    Rep. King moved to pass the bill out favorably. The motion passed unanimously with Rep. McCartney absent for the vote.


SB0087    Driver License Certificate Amendments (Sen. C. Walker) (Rep. D. Hogue)

    Sen. Walker explained the bill to the committee.

MOTION:    Rep. Dougall moved to pass the bill out favorably. The motion passed unanimously with Rep. McCartney absent for the vote.

MOTION:    Rep. Lockhart moved to adjourn the meeting. The motion passed unanimously with Rep. McCartney absent for the vote. The meeting adjourned at 4:45 p. m.
