The meeting was called to order by Chair Evans at 9:10 a.m.

MOTION: Sen. Hellewell moved to approve the minutes of 1-21-04.

The motion passed unanimously with Sen. Davis, Sen. Julander, and Sen. Wright absent at the time of the vote.

1. S.B. 76    Revisions to Royalty on Brine Shrimp (Sen. T. Hatch)

MOTION:
Sen. Hatch moved to delete in title and body S.B. 76 and insert in its place 1st Substitute S.B. 76 Revisions to Royalty on Brine Shrimp.

The motion passed with Sen. Evans, Sen. Hatch, and Sen. Hellewell voting in favor; Sen. Jenkins voting against and Sen. Davis, Sen. Julander and Sen. Wright absent at the time of the vote.

Sen. Hatch presented the substitute bill and proposed amendments.



MOTION: Sen. Hatch moved to adopt the following amendments to 1st Sub. S.B. 76:

Page 2, Lines 40 through 44
Delete Lines 40 through 44

The motion passed unanimously with Sen. Davis, Sen. Julander and Sen. Wright absent at the time of the vote.

MOTION: Sen. Hatch moved to adopt the following amendments to 1st Sub. S.B. 76:

1.    Page 1, Lines 17 through 18 :    

                 17          .    grants rulemaking authority to the Utah State Tax Commission

Sen. Evans turned the chair to Sen. Jenkins.

Debbie Goodman, Utah Audubon Society, Don Leonard, representing the brine shrimp industry, and Sherm Hoskins, Department of Natural Resources spoke in support of the bill.

MOTION: Sen. Wright moved to pass 1st Substitute S.B. 76, Revisions to Royalty on Brine Shrimp (T. Hatch) out with a favorable recommendation as amended.

The motion passed unanimously with Sen. Evans absent at the time of the vote.

2. S.B. 46     Sunset Date Extension of Division of Oil, Gas and Mining (Sen. M. Dmitrich)

Sen. Mike Dmitrich presented the bill. Lowell Braxton, Utah Division of Oil, Gas and Mining, spoke in support.


MOTION: Sen. Hellewell moved to pass S.B 46 Sunset Date Extension of Division of Oil, Gas and Mining (Sen. M. Dmitrich) out with a favorable recommendation.

The motion passed unanimously with Sen. Evans absent at the time of the vote.

3. H.B. 18     Utah State Scenic Byway Committee (Rep. J. Dougall)

Sen. Dmitrich presented the bill. Margaret Godfrey, Utah Travel Council, and Linda Hull, UDOT spoke in support.

MOTION: Sen. Davis moved to pass H. B. 18 Utah State Scenic Byway Committee out with a favorable recommendation.

The motion passed unanimously with Sen. Evans absent at the time of the vote.

Sen. Jenkins returned the chair to Sen. Evans

4. H.B. 49    Natural Gas Technician Certification (Rep. G. Snow)

Rep. Gordon E. Snow presented the bill. John Hill, Rocky Mountain Gas Association and Craig Cottle, Bureau Director, DOPL, spoke in support.

MOTION: Sen. Hellewell moved to amend H.B. 49 with the following amendment:

Page 11, Line 315 After "valve" insert "at the appliance"

The motion passed unanimously.

MOTION: Sen. Davis moved to pass H.B. 49 Natural Gas Technician Certification (Rep. G. Snow)
out with a favorable recommendation as amended.

The motion passed unanimously.

MOTION: Sen. Wright moved to adjourn.

The motion passed unanimously.

Chair Evans adjourned the meeting at 9:29 a.m.
