             8      LONG TITLE
             9      General Description:
             10          This bill amends H.B. 3, 2004 Supplemental Appropriations Act II, to redirect certain
             11      funds to Department of Corrections inmate housing projects and to direct certain
             12      General Fund one-time monies to construction of an inmate training center.
             13      Highlighted Provisions:
             14          This bill:
             15          .    requires that up to $1.5 million in federal VOI/TIS Funds be allocated to the
             16      Department of Corrections for capital improvements;
             17          .    if Federal VOI/TIS funds may not be used, requires that up to $1.5 million in
             18      Capital Improvement Funds be allocated to the Department of Corrections for
             19      capital improvements; and
             20          .    directs that $1.54 million in one-time General Fund monies be used to construct an
             21      inmate training center for the Wasatch and Oquirrh facilities of the Department of
             22      Corrections.
             23      Monies Appropriated in this Bill:
             24          This bill does not appropriate any monies but does modify legislative intent regarding
             25      the use of certain monies.



             26      Other Special Clauses:
             27          This bill provides an immediate effective date.

             33      Be it enacted by the Legislature of the state of Utah:
             34          Section 1. General provisions.
             35          Under the terms and conditions of Section 63-38-3, the following sums of money
             36      are appropriated from resources not otherwise appropriated, or reduced from amounts
             37      previously appropriated, out of the funds or fund accounts indicated for the use and support of
             38      the government of the State of Utah for the fiscal year beginning July 1, 2004 and ending June
             39      30, 2005. This is an addition to or a subtraction from amounts appropriated by S. B. 1,
             40      Appropriations Act, 2004 General Session.
             41          Section 2. Item 19, Chapter 370, Laws of Utah 2004 is amended to read:
             42          Item 19    To Capital Budget - DFCM Capital Program
             43                   [The Legislature intends that the Division of Facilities and]
             44                  [Construction Management shall use up to $1.5 million in]
             45                  [Capital Improvement funds for the remodeling and upgrade of]
             46                  [the Oxbow Jail for state use.] If the United States Department of
             47      Justice determines that Federal VOI/TIS Funds allocated in amended
             48      Item 20 in Section 3 of this bill may not be used for capital
             49      improvements in the Department of Corrections, the Legislature intends
             50      that up to $1.5 million in Capital Improvement Funds be used for capital
             51      improvements in the Department of Corrections.
             52          Section 3. Item 20, Chapter 370, Laws of Utah 2004 is amended to read:
             53          Item 20    To Capital Budget - Property Acquisition
             54                  From General Fund, One-time        1,540,000
             55                  From Federal Funds                2,200,000
             56                  Schedule of Programs:


             57                   Building/Land Purchases        3,740,000
             58                   The Legislature intends that the Commission on Criminal
             59                  and Juvenile Justice apply [$2.2] up to $1.5 million in Federal VOI/TIS
             60                  Funds [to the purchase of the Oxbow Jail.] for capital improvements in             
             61      the Department of Corrections.
             62          It is the intent of the Legislature that the $1.54 million from General Fund One-time
             63      monies be used to construct an inmate training center for the Department of Corrections'
             64      Wasatch and Oquirrh facilities.
             65          Section 4. Effective date.
             66          If approved by two-thirds of all the members elected to each house, this bill takes effect
             67      upon approval by the governor, or the day following the constitutional time limit of Utah
             68      Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto,
             69      the date of veto override.
