             7      LONG TITLE
             8      General Description:
             9          This bill creates a grant program to minimize out-of-pocket expenses of licensed
             10      teachers to obtain National Board certification or to take tests to meet federal highly
             11      qualified teacher standards.
             12      Highlighted Provisions:
             13          This bill:
             14          .    directs the State Board of Education to give grants to school districts and charter
             15      schools to pay costs directly related to enabling licensed teachers to obtain National
             16      Board certification or to take tests to meet federal highly qualified teacher
             17      standards;
             18          .    requires school districts and charter schools to provide matching funds to qualify for
             19      a grant;
             20          .    specifies how grant monies may be used; and
             21          .    repeals the grant program on July 1, 2008.
             22      Monies Appropriated in this Bill:
             23          This bill appropriates:
             24          .    $300,000 from the Uniform School Fund for fiscal year 2005-06 only, to the State
             25      Board of Education.
             26      Other Special Clauses:
             27          This bill takes effect on July 1, 2005.

             34      Be it enacted by the Legislature of the state of Utah:
             35          Section 1. Section 53A-6-112 is enacted to read:
             36          53A-6-112. Grants for licensed teachers.
             37          (1) As used in this section:
             38          (a) "Licensed teacher" means a teacher who holds:
             39          (i) a level 1, level 2, or level 3 license; and
             40          (ii) the endorsements required by board rule for the teacher's assignments.
             41          (b) "National Board certification" means a current certificate issued by the National
             42      Board for Professional Teaching Standards.
             43          (2) A grant program is created to minimize out-of-pocket expenses of licensed teachers
             44      to:
             45          (a) obtain National Board certification; or
             46          (b) take tests to meet federal highly qualified teacher standards as defined in 20 U.S.C.
             47      Sec. 7801.
             48          (3) The State Board of Education shall give grants to school districts and charter
             49      schools for the purpose stated in Subsection (2) from monies appropriated by the Legislature
             50      for that purpose.
             51          (4) To receive a grant, a school district or charter school shall provide matching funds
             52      to minimize out-of-pocket expenses of licensed teachers to obtain National Board certification
             53      or to take tests to meet federal highly qualified teacher standards in an amount equal to the
             54      grant.
             55          (5) Grant monies and matching funds shall be used to pay for costs of licensed teachers
             56      that are directly related to:
             57          (a) obtaining National Board certification; or
             58          (b) taking tests that, if the licensed teacher passes, the teacher meets federal highly


             59      qualified teacher standards.
             60          (6) The State Board of Education shall distribute money appropriated by the
             61      Legislature to school districts and charter schools to pay for costs of licensed teachers directly
             62      related to obtaining National Board certification or taking tests to meet federal highly qualified
             63      teacher standards in accordance with:
             64          (a) Subsection (4); and
             65          (b) a formula adopted by the board, after consultation with school districts and charter
             66      schools, that allocates the funding in a fair and equitable manner.
             67          (7) The State Board of Education shall make rules in accordance with Title 63, Chapter
             68      46a, Utah Administrative Rulemaking Act, to administer this section.
             69          Section 2. Section 63-55b-153 is amended to read:
             70           63-55b-153. Repeal dates -- Titles 53, 53A, and 53B.
             71          (1) Subsection 53-3-205 (9)(a)(i)(D) is repealed July 1, 2007.
             72          (2) Subsection 53-3-804 (2)(g) is repealed July 1, 2007.
             73          (3) Section 53A-1-403.5 is repealed July 1, 2007.
             74          (4) Subsection 53A-1a-511 (7)(c) is repealed July 1, 2007.
             75          (5) Section 53A-3-702 is repealed July 1, 2008.
             76          (6) Section 53A-6-112 is repealed July 1, 2008.
             77          [(6)] (7) Section 53B-8-104.5 is repealed July 1, 2009.
             78          Section 3. Appropriation.
             79          (1) There is appropriated $300,000 from the Uniform School Fund for fiscal year
             80      2005-06 only, to the State Board of Education to distribute to school districts and charter
             81      schools to pay for costs of licensed teachers directly related to obtaining National Board
             82      certification or taking tests to meet federal highly qualified teacher standards.
             83          (2) The money appropriated in Subsection (1):
             84          (a) shall be used as provided in Section 53A-6-112; and
             85          (b) is nonlapsing.
             86          Section 4. Effective date.
             87          This bill takes effect on July 1, 2005.
