             8      LONG TITLE
             9      General Description:
             10          This resolution of the House of Representatives requests that action be taken by the
             11      United States Senate.
             12      Highlighted Provisions:
             13          This resolution:
             14          .    requests that the United States Senate move quickly to confirm all presidential
             15      nominations to the United States Supreme Court.
             16      Special Clauses:
             17          None
             18     
             19      Be it resolved by the House of Representatives of the state of Utah:
             20          WHEREAS, Article II, Section 2 of the United States Constitution states the President
             21      "shall nominate, and by and with the Advice and Consent of the Senate, shall appoint
             22      Ambassadors, other public Ministers and Consuls, Judges of the Supreme Court, and all other
             23      Officers of the United States";
             24          WHEREAS, there is a high likelihood of at least one vacancy on the United States
             25      Supreme Court during the 109th Congress;
             26          WHEREAS, activist judges on some federal courts have frustrated the constitutional
             27      structure which prescribes that laws shall be written by elected legislatures;


             28          WHEREAS, President Bush has expressed his commitment to appoint federal judges
             29      who will strictly interpret the United States Constitution; and
             30          WHEREAS, in the past, a minority of senators has used dilatory tactics to prevent a
             31      Senate floor vote on several of President Bush's judicial nominees, all of whom were reported
             32      favorably by the United States Senate Committee on the Judiciary:
             33          NOW, THEREFORE, BE IT RESOLVED that the House of Representatives of the
             34      state of Utah requests that the United States Senate move quickly to confirm all presidential
             35      nominations to the United States Supreme Court.
             36          BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Majority
             37      Leader of the United States Senate and to the members of Utah's congressional delegation.
