             7      General Description:
             8          This bill creates the Federal Research Committee.
             9      Highlighted Provisions:
             10          This bill:
             11          .    establishes committee membership, duties, salaries, and designates staff for the
             12      committee;
             13          .    prescribes the issues that the committee may study;
             14          .    requires state agencies to supply data, reports, and other information to the
             15      committee at no cost to the committee;
             16          .    authorizes the committee to report to federal agencies; and
             17          .    requires the committee to present annual reports to the Legislative Management
             18      Committee and the governor.
             19      Monies Appropriated in this Bill:
             20          This bill appropriates:
             21          .    $2,500 to the Senate as an ongoing appropriation; and
             22          .    $2,500 to the House of Representatives as an ongoing appropriation.

             32      Be it enacted by the Legislature of the state of Utah:
             33          Section 1. Section 63-33a-101 is enacted to read:
             34     
CHAPTER 33a. FEDERAL RESEARCH COMMITTEE ACT

             35          63-33a-101. Title.
             36          This chapter is known as the "Federal Research Committee Act."
             37          Section 2. Section 63-33a-102 is enacted to read:
             38          63-33a-102. Creation -- Members -- Appointment -- Qualifications.
             39          (1) There is created a state Federal Research Committee composed of the following 13
             40      members:
             41          (a) two members of the Senate appointed by the president of the Senate, no more than
             42      one of whom may be from the same political party;
             43          (b) two members of the House of Representatives appointed by the speaker of the
             44      House of Representatives, no more than one of whom may be from the same political party;
             45          (c) the state planning coordinator or the coordinator's designee;
             46          (d) the executive director of the Department of Health or the executive director's
             47      designee;
             48          (e) the executive director of the Department of Community and Economic
             49      Development or the executive director's designee;
             50          (f) the executive director of the Department of Natural Resources or the executive
             51      director's designee;
             52          (g) the executive director of the Department of Environmental Quality or the executive
             53      director's designee;
             54          (h) the commissioner of the Department of Agriculture or the commissioner's designee;
             55      and
             56          (i) three members of the general public appointed by the governor, experienced with
             57      federal programs in the areas of health, public safety, defense, natural resources, or other areas
             58      significant to the economy of the state.


             59          (2) Seven or more members is a quorum.
             60          (3) (a) (i) A member of the committee who is not a government employee shall receive
             61      no compensation or benefits for the member's services, but may receive per diem and expenses
             62      incurred in the performance of the member's official duties at the rates established by the
             63      Division of Finance under Sections 63A-3-106 and 63A-3-107 .
             64          (ii) A member may decline to receive per diem and expenses for the member's services.
             65          (b) (i) A state government officer or employee member who does not receive salary,
             66      per diem, or expenses from the member's agency for the member's service may receive per
             67      diem and expenses incurred in the performance of the member's official duties at the rates
             68      established by the Division of Finance under Sections 63A-3-106 and 63A-6-107 .
             69          (ii) A state government officer or employee member may decline to receive per diem
             70      for the member's service.
             71          (c) Legislators on the committee shall receive compensation and expenses as provided
             72      by law and legislative rule.
             73          Section 3. Section 63-33a-103 is enacted to read:
             74          63-33a-103. Organization.
             75          (1) The committee shall select a chair and a vice chair from its own membership.
             76          (2) The original appointing authority shall fill any vacancies that occur on the
             77      committee.
             78          (3) The Governor's Office of Planning and Budget shall provide staffing for the
             79      committee.
             80          Section 4. Section 63-33a-104 is enacted to read:
             81          63-33a-104. Duties.
             82          (1) The Federal Research Committee shall:
             83          (a) review and make recommendations about:
             84          (i) federal installations in or pertaining to Utah;
             85          (ii) federal programs in or pertaining to Utah; and
             86          (iii) the impact of federal programs and installations in or pertaining to Utah on Utah
             87      citizens' health and public safety; and
             88          (b) study other issues that may be recommended by the committee including an
             89      evaluation of the merits of available prior and ongoing studies done by others about federal


             90      installations and federal programs in or pertaining to Utah.
             91          (2) Each state agency shall, if requested by the committee, provide data, reports, or
             92      other information without cost to the committee.
             93          (3) The committee may report or make recommendations to federal agencies on its
             94      findings.
             95          (4) The committee shall submit an annual report to the Legislative Management
             96      Committee and the governor by November 30 of each year.
             97          Section 5. Appropriation.
             98          As an ongoing appropriation subject to future budget constraints, there is appropriated
             99      from the General Fund for fiscal year 2004-05 $2,500 to the Senate and $2,500 to the House of
             100      Representatives.
