Rep. Dunnigan called the meeting to order at 8:07 a.m.

MOTION:    Rep. Adams moved to approve the minutes of the February 9, 2005 meeting. The motion passed unanimously.

H.B. 103    Student Housing Built by Higher Education Institutions (Rep. S. Clark)

Rep. S. Clark explained the bill, with the assistance of Ken Nye, Division of Facilities and Construction Management.

MOTION:    Rep. Snow moved to delete in title and body H.B. 103 and replace it with 1st Substitute H.B. 103. The motion passed unanimously, with Rep. Biskupski absent for the vote.

MOTION:    Rep. Frank moved to pass the bill out favorably. The motion passed unanimously.

MOTION:    Rep. Frank moved to recess for 10 minutes. The motion passed unanimously.


Rep. Dunnigan reconvened the meeting at 8:35 a.m.

H.B. 247    Credit or Refund for Tax Paid on Cigarette or Tobacco Product Destroyed or Returned to the Manufacturer (Rep. E. Hutchings)

Rep. Hutchings explained the bill, with the assistance of Pam Henrickson, Utah Tax Commission.

MOTION:    Rep. Morley moved to delete in title and body H.B. 247 and replace it with 1st Substitute H.B. 247. The motion passed unanimously.

MOTION:    Rep. Adams moved to amend the bill as follows:

1.    Page 1, Lines 23 through 24 :    

             23      Other Special Clauses:
             24          This bill
{   has retrospective operation to January   }        takes effect on July       1, 2005.


2.    Page 3, Lines 83 through 86 :    

             83          (2) A licensed person may apply to the commission for a credit or refund as provided

MOTION:    Rep. Kiser moved to adjourn the meeting. The motion passed unanimously, with Rep. Frank, Rep. Morley, Rep. Wyatt, and Rep. S. Clark absent for the vote.
