Chair Dayton called the meeting to order at 8:30 a.m. and welcomed committee members.
Rep. Moss was asked to give a one minute lesson on grammar.

MOTION:
    Rep. Newbold moved to approve the minutes of January 18, 2005. The motion
    passed unanimously with Representatives Bourdeaux, Dougall, Ferrin, Hughes,     and Shurtliff absent for the vote.    .
    
    
H.B.183    Verification of Eligibility for Fee Waivers (W. Harper)

Rep. Harper stated the bill requires a student qualifying for a fee waiver to provide verification of eligibility.
Superintendent Ray Timothy, Utah State Office of Education, answered questions about the bill and noted the State Board of Education didn't think the bill was necessary.

MOTION:
    Rep. Christensen moved to amend the bill as follows:



1.    Page 3, Lines 67 through 72

             67          (a) requiring a parent or guardian of a student applying for a fee waiver to provide
             68      documentation and certification to the school verifying
  :

    (i)  
the student's eligibility to receive the

             69      waiver; and
 

    (ii) that the alternatives for satisfying the fee requirements under Subsection (2) have been complied with to the fullest extent reasonably possible according to the individual circumstances of both the fee waiver applicant and the school: and  

             70          (b) specifying the acceptable forms of documentation for the requirement under
             71      Subsection (5)(a), which shall include verification based on income tax returns if the parent or
             72      guardian was required to file a return.

    The motion passed with Representatives Bourdeaux, Hogue, Moss, and      Shurtliff voting in opposition and Representatives Holdaway, and Johnson absent for the vote.

MOTION:.     Rep. Christensen moved to pass the bill out favorably. The motion passed     with Representatives Bourdeaux, Gowans, and Shurtliff voting in opposition
and Representatives Holdaway and Johnson absent for the
vote.

H.B.46     Public Education Capital Outlay Act Amendments (D. Cox)


MOTION:    Rep. Christensen moved to proceed to the next item on the agenda.

SUBSTITUTE MOTION:    Rep. Gowans moved to pass the bill out favorably. The motion
    failed with Representatives Gowans, Hogue, Johnson, Moss, and Shurtliff voting     in favor.

A vote was taken on the original motion to proceed to the next item on the agenda. The motion passed unanimously.


MOTION:    Rep. Hogue moved to pass out favorably H.C.R.6


SUBSTITUTE MOTION:    Rep. Ferrin moved to adjourn. The motion passed unanimously.         

Chair Dayton adjourned the meeting at 9:52 a.m.
