Rep. Ray called the meeting to order at 8:34 a.m.

MOTION:    Rep. Menlove moved to approve the minutes of the February 1, 2005 meeting. The motion passed unanimously with Rep. Buxton, Rep. Litvack, and Rep. Lockhart absent for the vote.


S.B. 90    County Officers Serving on Boards of County Mental Health and Substance Abuse Providers (Sen. D. Thomas)

Sen. Thomas introduced S.B. 90 and explained it to the committee.

Rep. Mascaro declared a conflict of interest.

Spoke in favor of the bill:    Arie Van De Graaff, Utah Association of Counties

MOTION:    Rep. Mascaro moved to pass the bill out favorably. The motion passed unanimously .

MOTION:    Rep. Mascaro moved to place S.B. 90 on the Consent Calendar. The motion passed unanimously.


H.B. 62    Amendments to Intermediate Care Facilities for Mentally Retarded (Rep. R. Lockhart)

MOTION:    Rep. Lockhart moved to amend the bill as follows:


0.    Page 2, Lines 31 through 35 :    

             31          (1) (a) "Nursing care facility" means:
             32          (i) a nursing care facility described in Subsection 26-21-2 (17)[.];
             33          (ii)
  beginning January 1, 2006,       a designated swing bed in        :

    (A)  
a general acute hospital as defined in Subsection

             34      26-21-2 (11); and
 

    (B) a critical access hospital which meets the criteria of 42 U.S.C. 1395i- 4(c)(2)(1998); and  

             35          (iii) an intermediate care facility for the mentally retarded that is licensed under Section

The motion to amend the bill passed unanimously.

Rep. Lockhart introduced H.B. 62 as amended and explained it to the committee. She was assisted by Dirk Anjewierden, Utah Health Care Association.

MOTION:    Rep. Menlove moved to pass the bill as amended out favorably. The motion passed unanimously.

S.B. 93    Children's Justice Center Addition (Sen. T. Hatch)

Sen. Hatch introduced S.B. 93 and explained it to the committee.

Spoke in favor of the bill:    Craig Peterson, citizen

MOTION:    Rep. Litvack moved to pass the bill out favorably. The motion passed unanimously.


MOTION:    Rep. Lockhart moved to adjourn the meeting. The motion passed unanimously.
