Rep. Ray called the meeting to order at 4:26 p.m.

MOTION:    Rep. Litvack moved to approve the minutes of the February 11, 2005 meeting. The motion passed unanimously.


H.B. 310    Aging and Adult Services Program Amendments (Rep. E. Hutchings)

H.B. 310 was not considered at this meeting.


S.B. 50    Controlled Substance Amendments (Sen. P. Arent)

Sen. Arent presented S.B. 50 to the committee, assisted by Laura Poe, Division of Occupational and Professional Licensing.

Spoke to the bill:    Dr. Christy Porucznik, Utah Department of Health

MOTION:    Rep. Jones moved to pass the bill out favorably. The motion passed with Rep. Buxton and Rep. Ray voting in opposition to the motion. Rep. Lockhart and Rep. Last were absent for the vote.



S.B. 55    Access to Patient Medical Records (Sen. P. Arent)

Sen. Arent presented S.B. 55 to the committee, assisted by Laura Poe, Division of Occupational and Professional Licensing.

Spoke to the bill:    Cathy Dupont, Associate General Counsel, Office of Legislative Research and General Counsel

MOTION:    Rep. Jones moved to pass the bill out favorably. The motion passed unanimously with Rep. Lockhart and Rep. Last absent for the vote.

MOTION:    Rep. Jones moved to place S.B. 55 on the Consent Calendar. The motion passed unanimously with Rep. Lockhart and Rep. Last absent for the vote.


H.B. 233    Adoption Law Revisions (Rep. R. McGee)

MOTION:    Rep. Ray moved to amend the bill as follows:

1.    Page 1, Line 26 through Page 2, Line 29 :    

             26          (1) [Prior] Except as provided in Subsection (4), prior to the date that a final decree of
             27      adoption is entered
{   in any adoption proceeding   } , an affidavit regarding fees and expenses,

             28      signed by the adoptive parent or parents and the person or agency placing the child, shall be
             29      filed with the court. [That]

The motion to amend the bill passed unanimously with Rep. Lockhart and Rep. Last absent for the vote.

Rep. McGee presented H.B. 233 as amended to the committee.

MOTION:    Rep. Buxton moved to pass the bill as amended out favorably. The motion passed unanimously with Rep. Lockhart and Rep. Last absent for the vote.

MOTION:    Rep. Litvack moved to place H.B. 233 as amended on the Consent Calendar. The motion passed unanimously with Rep. Lockhart and Rep. Last absent for the vote.



H.J.R. 19    Joint Resolution Urging Health Care for Utah's Indigent and Needy Uninsured (Rep. L. Fowlke)

Rep. Fowlke presented H.J.R. 19 to the committee. She was assisted by Paul Mero of the Sutherland Institute, who distributed a handout to committee members.
