    Representative Ferrin called the meeting to order at 2:05 p.m. and welcomed committee members.

H.B. 54    Criminal Appeal Amendments (Rep. S. Wyatt)

MOTION:    Representative Wyatt moved to amend as follows:


1.    Page 3, Lines 78 through 81 :    

             78          (j) an illegal sentence.
             79          (4) In addition to any appeal permitted by Subsection (3), the prosecution may seek
             80      discretionary appellate review of any interlocutory order
{   issued   }        entered       before jeopardy attaches.

             81          Section 2. Section 78-3a-604 is enacted to read:





        The motion passed unanimously 11-0-2 with Representative Ferry and         Representative McGee absent for the vote.

    Representative Wyatt introduced the bill and explained its intent.

MOTION:    Representative Hogue moved to pass the bill out favorably as amended. The         motion passed unanimously 11-0-2 with Representative Ferry and Representative McGee absent for the vote.

H.B. 55    Drug Offense Penalty Enhancements (Rep. B. Dee)

    Representative Dee introduced the bill and explained its intent. He was assisted by Chris Zimmerman, Chief Deputy, Weber County Sheriff's Office.

Steve Erickson, Citizens Education Project, spoke against the bill.

MOTION:     Representative Hutchings moved to pass the bill out favorably. The motion passed
        unanimously 11-0-2 with Representative Ferry and Representative McGee absent for the vote.

MOTION:    Representative Hogue moved to adjourn. The motion passed unanimously 11-0-2         with Representative Ferry and Representative McGee absent for the vote.

    Representative Ferrin adjourned the meeting at 2:52 p.m.
