Rep. Barrus called the meeting to order at 2:02 p.m.

MOTION:    Rep. Cox moved to approve the minutes of the January 19, 2005 meeting. The motion passed unanimously, with Rep. Biskupski, Rep. Dayton, Rep. Duckworth, and Rep. Walker absent for the vote.

1st Sub. H.B. 182    Historical Livestock Trails (Rep. B. Johnson)

MOTION:    Rep. Johnson moved to amend the bill as follows:

1.    Page 2, Lines 40 through 46 :    

             40          (3) Notwithstanding Subsections (1) and (2), the owner of any neat cattle, horse, ass,
             41      mule, sheep, goat, or swine that trespasses upon the premises of another person is not liable in
             42      a civil action to the owner or occupant of the premises for damage inflicted by the trespass if:


             43          (a) the animal enters the premises from an historic livestock trail, as defined in Section
             44      57-13b-102 ; and
             45          (b) the premises that was trespassed is not enclosed by
{   a   }        an adequate       fence at the time the trespass

             46      occurs.

The motion to amend passed unanimously, with Rep. Biskupski, Rep. Dayton, and Rep. Duckworth absent for the vote.

MOTION:    Rep. Cox moved to pass the bill out favorably as amended. The motion passed unanimously, with Rep. Duckworth absent for the vote.

H.B. 160    Wildlife License Agents Amendments (Rep. J. Fisher)

Rep. Fisher explained the bill.

MOTION:    Rep. Biskupski moved to pass the bill out favorably. The motion passed unanimously, with Rep. Duckworth absent for the vote.

MOTION:    Rep. Biskupski moved to place H.B. 160 on the Consent Calendar. The motion passed unanimously, with Rep. Duckworth absent for the vote.

H.B. 168    Cooperative Wildlife Management Unit Amendments (Rep. J. Gowans)

Rep. Gowans explained the bill with the assistance of Miles Moretti, Director, Division of Wildlife Resources.

MOTION:    Rep. Buttars moved to pass the bill out favorably. The motion passed unanimously.

MOTION:    Rep. Cox moved to adjourn the meeting. The motion passed unanimously, with Rep. Biskupski absent for the vote.
