Rep. Noel called the meeting to order at 4:17 p.m.

MOTION:    Rep. Painter moved to approve the minutes of the February 4, 2005 meeting. The motion passed unanimously, with Rep. Biskupski, Rep. Buttars, Rep. Dayton, Rep. Duckworth, and Rep. Johnson absent for the vote.

H.B. 83    Weights and Measures Amendments (Rep. D. Ure)

MOTION:    Rep. Ure moved to delete in title and body H.B. 83 and replace it with 1st Substitute H. B. 83. The motion passed unanimously, with Rep. Biskupski, Rep. Buttars, Rep. Dayton, Rep. Duckworth, and Rep. Johnson absent for the vote.

Rep. Ure explained the bill with the assistance of Jim Olson, President, Utah Food Industry Association.


MOTION:    Rep. Ure moved to pass the bill out favorably. The motion passed unanimously, with Rep. Buttars, Rep. Dayton, Rep. Duckworth, and Rep. Johnson absent for the vote.

H.B. 230    Recycling of Waste Tires (Rep. D. Ure)

Rep. Ure explained the bill.

Rep. Wheeler declared a conflict of interest.

Spoke to the bill:    Nicole Prokop, Holcim

            Rob Jahries, Utah Tire Recycling

MOTION:    Rep. Ure moved to amend the bill as follows:

1.    Page 1, Lines 14 through 15 :    

             14              .    
{   $85   }        $90       as partial reimbursement for each ton of waste tires converted to crumb

             15      rubber;

2.    Page 3, Lines 59 through 62 :    

             59          (2) [(a)] Subject to the limitations in Section 19-6-816 , a recycler is entitled to [$75]:
             60          (a)
{   $85   }        $90       as partial reimbursement for each ton of waste tires or material derived from

             61      waste tires converted to crumb rubber, if a contract exists for the sale of the crumb rubber for
             62      use as a component in an ultimate product[.];

The motion to amend passed unanimously, with Rep. Biskupski and Rep. Dayton absent for the vote.

MOTION:    Rep. Gowans moved to pass the bill out favorably as amended. The motion passed unanimously, with Rep. Biskupski and Rep. Dayton absent for the vote.
    




H.B. 152    County Option Sales and Use Tax for Agricultural Land, Open Land, and Recreational Facilities Act (Rep. C. Buttars)

Rep. Buttars explained the bill.

The motion to amend passed unanimously, with Rep. Biskupski absent for the vote.

MOTION:    Rep. Barrus moved to adjourn the meeting. The motion passed, with Rep. Buttars and Rep Johnson voting in opposition and Rep. Biskupski absent for the vote.
