Rep. Lawrence called the meeting to order at 9:02 a.m.

MOTION:             Rep. Menlove moved to approve the minutes of January 25, 2005. The motion passed
            unanimously, with Rep. Shurtliff absent for the vote.

H.B. 159 Motor Assisted Scooter and Mini-motorcycle Amendments (Rep. B. Dee)

Rep. Dee introduced H.B. 159 and explained it to the committee.

MOTION:    Rep. Hardy moved to amend the bill as follows:

1.    Page 4, Lines 112 through 118 :    

             112          (21) (a) "Mini-motorcycle" means a motorcycle or motor-driven cycle that has a seat or
             113      saddle that is less than 24 inches from the ground as measured on a level surface with properly
             114      inflated tires.
             115          (b) "Mini-motorcycle" does not include a moped or a motor assisted scooter.
             116          (c) "Mini-motorcycle" does not include a motorcycle that is:
    
  (i) legally licensed and registered for highway use;      

             117          
{   (i)   }        (ii)       designed for off-highway use; and

             118          
{   (ii)   }        (iii)       registered as an off-highway vehicle under Section 41-22-3 .




The motion to amend the bill passed unanimously.

MOTION:    Rep. Buxton moved to reconsider Rep. Hardy's amendment on H.B. 159. The motion passed unanimously.

MOTION:    Rep. Fisher moved to amend the bill as follows:

1.    Page 4, Lines 112 through 118 :

             271      an adult operator may carry a child securely attached to the operator in a pack or sling  
}

The motion to amend the bill passed unanimously, with Rep. King absent for the vote.

MOTION:    With the permission of the committee and due to the shortage of time, Rep. Lawrence moved to further amend the bill as follows:

1.    Page 3, Lines 69 through 70 :    

             69          (9) "Direct supervision" means oversight at a distance within which
  :

    (a)  
visual contact is





             70      maintained
{   for the purpose of advising and assisting   }        ; and

    (b) advice and assistance can be given and received  
.


The motion to amend the bill passed unanimously, with Rep. King absent for the vote.

MOTION:    Rep. Shurtliff moved to pass the bill out favorably. The motion passed unanimously, with Rep. King absent for the vote.

MOTION:    Rep. Buxton moved to adjourn the meeting. The motion passed unanimously, with Rep. King absent for the vote.

Rep. Lawrence adjourned the meeting at 10:00 a.m.
