Rep. Lawrence called the meeting to order at 4:35 p.m.

MOTION:    Rep. Dee moved to approve the minutes of February 21, 2005. The motion passed unanimously, with Rep. Becker, Rep. Buxton, Rep. Holdaway, Rep. King, and Rep. Menlove absent for the vote.

H.B. 335    Disconnecting Territory from a Municipality (Rep. C. Frank)

Rep. Frank with the help of Jodi Hoffman, Utah League of Cities and Towns, introduced the bill and explained it to the committee.

MOTION:    Rep. Shurtliff moved to delete in title and body H.B. 335 and to replace it with 1st Substitute H.B. 335. The motion passed unanimously, with Rep. Becker, Rep. Buxton, Rep. Holdaway, and Rep. Menlove absent for the vote.

MOTION    Rep. Shurtliff moved to amend the bill as follows:

1.    Page 7, Lines 190 through 191 :    

             190          (e) The commission
{   shall   }        may       grant a petition and adjust the common boundary as

             191      requested if:



The motion passed unanimously, with Rep. Becker, Rep. Buxton, and Rep. Holdaway absent for the vote.

MOTION:    Rep. Buxton moved to pass 1st Sub H.B. 335 out favorably as amended. The motion passed unanimously, with Rep. Becker and Rep. Holdaway absent for the vote.

H.B. 158    Election Requirements for County Candidates (Rep. R. Romero)

Rep. Romero with the help of Mark Stevens, Utah Association of Certified Public Accountants, introduced the bill and explained it to the committee.    

MOTION:    Rep. Shurtliff moved to amend H.B. 158 as follows:

1. Page 3, Lines 81 through 82

             81          (2) if filing for candidacy in a first class county after January 1,
{   2006   }        2010       , be a licensed

             82      certified public accountant as of the date of filing.

The motion passed unanimously, with Rep. Becker and Rep. Holdaway absent for the vote.

MOTION:    Rep. King moved to pass H.B. 158 out favorably as amended. The motion failed with a 5-5-1 vote, with Rep. Becker, Rep. King, Rep. Menlove, Rep. Shurtliff, and Rep. Lawrence voting yes, and Rep. Buxton, Rep. Fisher, Rep. Gibson, Rep. Hardy, and Rep. Dee voting no, with Rep. Holdaway absent for the vote.

H.J.R. 18    Joint Resolution Supporting Counties Expansion of Correctional Facilities (Rep. D. Hogue)

Rep. Hogue with the help of Chris Mitchell, Department of Corrections, introduced the bill and explained it to the committee.


MOTION:    Rep. Gibson moved to pass H.J.R. 18 out favorably. The motion passed unanimously, with Rep. Holdaway absent for the vote.



S.B. 136        Justice Court Operations Amendments (Sen. E. Mayne)
            Rep. King briefly talked on the status of this bill.

S.B. 139        Minimum Wage Provisions (Sen. H. Stephenson)
            This bill was not considered.

1st Sub. S.B. 80 Special Service Districts - Service Expansion (Sen. M. Dmitrich)

Sen. Dmitrich introduced the bill and explained it to the committee.

Spoke to the bill:    Jan Furner, Executive Director, Utah Association of Special Districts

MOTION:    Rep. Buxton moved to pass 1st Sub S.B. 80 out favorably. The motion passed unanimously, with Rep. Holdaway absent for the vote.

MOTION:    Rep. Dee moved to adjourn the meeting. The vote was unanimous. Rep. Lawrence adjourned the meeting at 6:08 p.m.
