Representative Hunsaker called the meeting to order at 8:02 a.m.

MOTION:    Rep. Daw moved to approve the minutes of February 1, 2005. The motion passed unanimously with Rep. Tilton absent for the vote.

H.B. 238    Utah Technology Commission Membership
(Rep. J. Dougall)

Rep. Dougall explained the bill.

MOTION:    Rep. Daw moved to amend the bill as follows:


1.    Page 1, Lines 26 through 27 :    

             26      Other Special Clauses:
             27          
{   None   }        This bill provides an immediate effective date.      


2.    Page 11, Lines 312 through 313 :    

             312          (6) Any meeting of the committee is subject to Title 52, Chapter 4, Open and Public


             313      Meetings.
  Section 6. Effective date.

     If approved by two-thirds of all the members elected to each house, this bill takes effect upon approval by the governor, or the day following the constitutional time limit of Utah Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto, the date of veto override.  



The motion to amend passed unanimously with Rep. Tilton and Rep. Wheeler absent for the vote.

MOTION:    Rep. Ure moved to pass the bill out favorably as amended. The motion passed unanimously with Rep. Tilton absent for the vote.

H.B. 145    Amendments to Hearing and Speech Impaired Telecommunications Program (Rep. B. Goodfellow)

Rep. Goodfellow explained the bill.

MOTION:    Rep. Goodfellow moved to amend the bill as follows:

1.    Page 4, Lines 91 through 92 :    

             91          (c)
  (i)       The commission      {   may   }        shall       make rules under Title 63, Chapter 46a, Utah Administrative

             92      Rulemaking Act, for the administration of monies under Subsection (5)(b)(vi).
    
  (ii) The commission shall give notice and hold a public hearing for any rules proposed under Subsection (c)(i).

MOTION:    Rep. Ure moved to pass the bill out favorably.

H.B. 234    Telephone Surcharge for Education and Training Programs At Prison
         (Rep. B. Goodfellow)

Rep. Goodfellow explained the bill.

MOTION:    Rep. Goodfellow moved to amend the bill as follows:

1) Page 2, line 43:        After "to the" delete "department of corrections"
                Insert "Board of Regents"

Spoke to the bill:    D'Arcy Dixon, Department of Administrative Services    
            Ronald Mortensen, Sutherland Institute

MOTION:    Rep. Fowlke moved to hold the bill, and to place it on the next agenda.

SUBSTITUTE
MOTION:    Rep. Noel moved to pass the bill out favorably. The motion failed with Rep.         Daw, Rep. Fowlke, Rep. Tilton, and Rep. Ure voting in opposition.

The original motion to hold the bill passed unanimously.

MOTION:    Rep. Fowlke moved to adjourn. The motion passed unanimously. Rep. Hunsaker adjourned the meeting at 9:35 a.m.
