Committee Chair Thomas called the meeting to order at 8:10 a.m.
1. Approval of Minutes
MOTION: Sen. Hale moved to approve the minutes of 1-21-05. The motion passed unanimously. Absent for the vote were: Sen. P. Arent, Sen. C. Buttars, and Sen. D. Eastman.
Chair Thomas outlined which bills would be considered and announced that H.B. 36 lst Sub., Charter School Construction Amendments, would be held at the request of the sponsor Rep. James A. Ferrin.
2. S.B. 58 Liability Protection of Educators (Sen. H. Stephenson)
Sen. Stephenson presented the bill. Gary Cameron, Utah School Boards and School Superintendents Association stated the organizations have taken no formal position on the bill but he personally thought it to be unnecessary.
MOTION: Sen. Madsen moved to pass S.B. 58 Liability Protection of Educators (Sen. H. Stephenson) out with a favorable recommendation.
The motion passed unanimously. Absent for the vote were: Sen. P. Arent, Sen. C. Buttars, and Sen. D. Eastman.
3. S.B. 41 School and Institutional Trust Lands Management Act Revisions (Sen. M. Dmitrich)
Sen. Mike Dmitrich presented the bill and introduced Kevin Carter, Director, Schools and Institutional Trust Fund Administration, who explained the bill.
MOTION: Sen. Stephenson moved to pass S.B. 41, School and Institutional Trust Lands Management Act Revisions (Sen. M. Dmitrich) out with a favorable recommendation.
The motion passed unanimously. Absent for the vote were: Sen. P. Arent, Sen. C. Buttars and Sen. D. Eastman.
4. S.B. 59 Home School Amendments (Sen. M. Madsen)
Sen. Madsen presented the bill and declared a conflict of interest. Chair Thomas also declared a conflict of interest. Shane Schulthies, Angie Baker, Ann Meeks, Audrey Rudlisbaker, Frank Mylar, Kelly Rogers, Julie Earl, Holly Robbins, Tad Wimmer, Lucas Johnson, Myranda Holgerson, and Karen Clark, Utah Eagle Forum, spoke in support of the bill. Marilyn Kofford, Utah PTA, and Susan Koviack, Utah Education Association, voiced some concerns but took no position on the bill.
MOTION: Sen. Arent moved to pass S.B. 59 Home School Amendments (Sen. M. Madsen)
out with a favorable recommendation.
The motion passed unanimously.
H.C. R. 9, Resolution Honoring Outgoing USU President Kermit L. Hall (Rep. F. Hunsaker) was not considered.
MOTION: Sen. Hale moved to adjourn. The motion passed unanimously.
Chair Thomas adjourned the meeting at 9:30 a.m.
