Committee Chair Christensen called the meeting to order at 4:22 p.m.

MOTION: Sen. McCoy moved to approve the minutes of February 14, 2005.

The motion passed unanimously.

1.    S.B. 279 Clinical Counselor - Title Change (L. Fowlke)

    Rep. Fowlke explained the bill.

     MOTION: Sen. McCoy moved to pass the bill with a favorable recommendation.

    The motion passed unanimously.

     MOTION: Sen. Bell moved to have the bill placed on the consent calendar.

    The motion passed unanimously.

2.    S.B. 212S1 Child Care Investigations - (P. Hellewell)

    Sen. Hellewell explained that there were concerns by the Department of Health about the



    bill as it was originally drafted. After meeting with the department and addressing those concerns, First Substitute S.B. 212 was drafted. Sen. Hellewell presented First Substitute S.B. 212 to the committee.

    Iona Thraen, Utah Department of Health, answered questions from the committee and spoke in support of the bill.

    Karen Silver, Advocate, Salt Lake Community Action Program, raised concerns about the bill.

    Johnny Anderson, Exec. Director, Utah Private Child Care Assn., spoke in favor of the bill.
        
     MOTION: Sen. McCoy moved to amend First Substitute S.B. 212 as follows:


1.    Page 4, Line 95 :    

             95          (i) the supervisor determines the complaint is
{   legitimate   }        credible       ;

    
    The motion passed unanimously.

     MOTION:    Sen. Bell moved to pass out First Substitute S.B. 212, as amended by the committee, with a favorable recommendation.

    The motion passed unanimously.

3.    S.B. 165 Child Welfare Services (P. Hellewell)

    Sen. Hellewell requested the bill be returned to the Rules Committee.

     MOTION: It was duly moved to return S.B. 165 to the Rules Committee.

    The motion passed unanimously.
    
4.    S.B. 186 Child Welfare Removal - Adoption Option
(P. Hellewell)

    This item was not considered.

     MOTION: Sen. Bell moved to adjourn.

    The motion passed unanimously.


    
Sen. Christensen adjourned the meeting at 5:00 p.m.
