APPROVAL OF MINUTES:

    MOTION:
Sen. Bell moved to approve the minutes of February 3, 2005.

    The motion passed unanimously with Sen. Allen and Sen. Dmitrich absent for the vote.

1.     H.B. 9 SALES AND USE TAX - AGRICULTURAL EXEMPTION VEHICLE LIMITATION (Rep. R. Menlove)

    
Rep. Menlove presented the bill to the committee.



     Lynn Solarczyk, Utah State Tax Commission, and Todd Bingham, Utah Farm Bureau, spoke     to the bill.

    MOTION: Sen. Peterson moved to pass H. B. 9 out of committee with a favorable recommendation.

    The motion passed unanimously with Sen. Allen and Sen. Dmitrich absent for the vote.

2.     S. B. 161 AMENDMENTS TO THE PROPERTY TAX VALUATION AGENCY FUND ASSESSING AND COLLECTING LEVY (Sen. H. Stephenson)

    
Sen. Stephenson presented the bill to the committee.

    Sen. Bell assumed the Committee Chair.

    Brent Gardner and Blake Frazier, Utah Association of Counties, spoke to the bill.

    MOTION:
Sen. Stephenson moved to pass S.B. 161 out of committee with a favorable recommendation.

    The motion passed unanimously with Sen. Bramble, Sen. Allen and Sen. Dmitrich absent     for the vote.

3.     H.B. 171 CALCULATION OF MINING SEVERANCE TAX ON BERYLLIUM (Rep. R. Wheeler)

    Rep. Wheeler presented the bill to the committee.

    Mark Buchi, HOlmes, Roberts, and Owens, and David Litvn, Utah Mining Association,     spoke to the bill.

     MOTION: Sen. Stephenson moved to pass H. B. 171 out of committee with a favorable     recommendation.

    The motion passed unanimously with Sen. Bramble, Sen. Allen, and Sen. Dmitrich absent for     the vote.
    

4.    H. B. 1ST SUB. 190 INDIVIDUAL INCOME TAX - ELECTRONIC FILING     REQUIREMENTS ( Rep. S. Clark)

    Rep. Clark presented the bill to the committee.



    Rod Morreli and Bruce Johnson, Utah State Tax Commission, spoke to the bill.

     MOTION: Sen. Peterson moved to pass 1st. Sub. H.B.190 out of committee with a     favorable recommendation.

    The motion passed unanimously with Sen. Bramble, Sen. Allen, and Sen. Dmitirch absent at     the time of the vote.

5.     H. B. 53 TAX TREATMENT OF PERSONAL PROPERTY (Rep. L. Shurtliff)

    Rep. Shurtliff presented the bill to the committee.

    Bruce Johnson, Utah State Tax Commission; Wayne Jones, Utah R.V. Dealers Association;
    and Keith Burnham, Citizen, spoke to the bill.

    A motion was made by Sen. Bell to have a floor amendment prepared, clarifying the tracking     process that would be used by the Utah Tax Commission to determine lost revenue due to     this bill, to be presented on the floor of the Senate.

     MOTION: Sen. Dmitrich moved to pass H.B. 53 out of committee with a favorable     recommendation.

    The motion passed unanimously with Sen. Bramble absent for the vote.

6.    S.B. 164 INDIVIDUAL INCOME TAX - SUBTRACTION FOR LIVE ORGAN     DONATION EXPENSES (Sen. K. Hale)

    
S.B. 164 was not considered.

     MOTION: Sen. Allen moved to adjourn.

    The motion passed unanimously with Sen. Bramble absent for the vote.

    Sen. Bell adjourned the meeting at 9:10 a.m.
