APPROVAL OF MINUTES:


    MOTION:
Sen. Bell moved to approve the minutes of February 14, 2005.

    The motion passed unanimously with Sen. Allen, Sen. Dmitrich, and Sen. Valentine absent for     the vote.

1.     S.B. 189 PROPERTY TAX - CERTIFIED TAX RATE ADJUSTMENT (Sen. G. Bell)
    

    MOTION: Sen. Bell moved to return S.B. 189 back to the committee.

    The motion passed unanimously with Sen. Allen, Sen. Dmitrich, and Sen. Valentine absent for     the vote.

2.     S.B. 227 PUBLIC SAFETY DRIVING PRIVILEGE AND IDENTIFICATION CARD AMENDMENTS (Sen. C. Bramble)

    MOTION:
Sen. Bramble moved to amend S.B. 227 as follows:

1.    Page 2, Lines 41 through 42 :    

             41      Other Special Clauses:
             42          
{   This bill takes effect on July 1, 2005.   }

    
  This bill provides an immediate effective date.      


2.    Page 8, Lines 231 through 234 :    

             231          (ii) The receipt serves as a temporary license certificate or
  temporary       driving privilege card

             232      allowing [him] the person to drive a motor vehicle while the division is completing its
             233      investigation to determine whether [he] the person is entitled to be [licensed] granted a driving
             234      privilege.

3.    Page 9, Lines 262 through 264 :    

             262          [(5)] (8) The division shall issue temporary license certificates or
  temporary       driving privilege

             263      cards of the same nature, except as to duration, as the license certificates
  or driving privilege cards       that they temporarily

             264      replace, as are necessary to implement applicable provisions of
  this section and       Section 53-3-223 .



4.    Page 11, Lines 333 through 334 :    

             333          Section 5. Effective date.
             334          
{   This bill takes effect on July 1, 2005.   }

    
  If approved by two-thirds of all the members elected to each house, this bill takes effect upon approval by the governor, or the day following the constitutional time limit of Utah Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto, the date of veto override.      

    

    The motion passed with Sen. Allen, Sen. Dmitrich, and Sen. Valentine absent for the vote.
    
    Sen. Bramble presented the bill to the committee

    John Schaff, Auditor General's Office; Jim Behunin, Auditor General's Office; Claron     Brenchley, Department of Public Safety, and Judy Hamaker-Mann, Department of Public     Safety, spoke to the bill.
        
     MOTION: Sen. Bramble moved to pass S.B. 227, as amended, out of committee with a favorable recommendation.

    The motion failed with Sen. Allen, Sen. Bell and Sen. Dmitrich voting against and Sen.     Valentine absent for the vote.

3.     S.B. 184 REDEVELOPMENT AGENCY AMENDMENTS (Sen. C. Bramble)

    Sen. Bramble presented the bill to the committee.

    Randy Sant, Sandy Economic Development spoke to the bill. Larry Newton, State Office of     Finance; Steve White, Utah County Commissioner; Ronda Rose, Utah Parent Teacher;     Association; Courtney White, Utah Education Association; Gayle Ruzicka, Eagle Forum,     and Dan McConkie, Davis County Commissioner, spoke in support of the bill.

    Lincoln Shurtz, Utah Legislative Task Force; Mike Jerman, Utah Taxpayers Association;
    Robin Bagley, Citizen, and Dean Hawes, REAL SL, spoke in opposition.

     MOTION: Sen. Peterson moved to pass S.B. 184 out of committee with a favorable     recommendation.

    The motion passed unanimously with Sen. Allen and Sen. Valentine absent for the vote.

4.    S.B. 227 PUBLIC SAFETY DRIVING PRIVILEGE AND IDENTIFICATION CARD     AMENDMENTS ( Sen. C. Bramble)



    MOTION:
Sen. Bramble moved to reconsider the committe's action on S.B. 227, as amended.

    The motion passed with Sen. Dmitrich voting against and Sen. Allen and Sen. Bell absent     for the vote.

     MOTION: Sen. Bramble moved to pass S.B. 227, as amended, out of committee with a     favorable recommendation.

    The motion passed with Sen. Dmitrich voting against and Sen. Allen and Sen. Bell absent     for the vote.

5.    S.B. 204 SALES AND USE TAX DIVERSIONS (Sen. D. Peterson)

    
Sen. Peterson presented the bill to the committee.

    Fred Finlinson, Water Coalition; Mike Canning, Wildlife Resources, and Don Peay, Citizen,
     spoke to the bill.

     MOTION: Sen. Bramble moved to pass S.B. 204 out of committee with a favorable     recommendation.

    The motion passed unanimously with Sen. Allen, Sen. Bell and Sen. Valentine absent for the     vote.     
    
6.    S.B. 63 SEVERANCE TAX AMENDMENTS (Sen. B. Evans)

    MOTION:
Sen. Dmitrich moved to pass S.B. 63 out of committee with a favorable     recommendation.

    Sen. Evans presented the bill to the committee.

     SUB. MOTION: Sen. Bramble moved to adjourn .

    
The motion passed with Sen. Dmitrich voting against and Sen. Allen and Sen. Valentine     absent for the vote.
    
    Sen. Bramble adjourned the meeting at 9:30 a.m.
