APPROVAL OF MINUTES:

    MOTION:
Sen. Peterson moved to approve the minutes of February 16, 2005.

    The motion passed unanimously with Sen. Stephenson, and Sen. Hillyard absent for the vote.

1.     S.B. 205 INDIVIDUAL INCOME TAX - OFFICE OF STATE DEBT COLLECTION RULEMAKING AUTHORITY (Sen. M. Dmitrich)


    
Sen. Dmitrich presented the bill to the committee.

     MOTION: Sen. Allen moved to pass S. B. 205 out of committee with a favorable     recommendation.

    The motion passed unanimously with Sen. Stephenson and Sen. Hillyard absent at the time of     the vote.

2.     SCR 2 RESOLUTION APPROVING CLASS V LANDFILL (Sen. R. Allen)

    MOTION:
Sen. Allen moved to amend SCR 2 as follows:

1.    Page 1, Line 24 through Page 2, Line 28 :    

             24          
{   .    provides that an operation plan for the landfill has been submitted to the

             25      Department of Environmental Quality for approval; and
             26          .    provides that the legislative and gubernatorial approval required by statute and
             27      stated in this resolution will only take effect following the granting of approval of
             28      an operation plan by the Department of Environmental Quality.  
}
 

    .    provides that an operation plan for the landfill was approved by the executive secretary of the Solid and Hazardous Waste Control Board; and
    .    grants approval to the Wasatch Regional Solid Waste Management Corporation and the School and Institutional Trust Lands Administration for the construction and operation of a Class V commercial nonhazardous solid waste landfill.  


2.    Page 2, Lines 51 through 56 :    

             51          WHEREAS, Wasatch Regional Solid Waste Management Corporation and the School
             52      and Institutional Trust Lands Administration have submitted a proposed operation plan for the
             53      Wasatch Regional Solid Waste Landfill as a Class V commercial nonhazardous solid waste
             54      landfill to the Department of Environmental Quality, and
{   the Department of Environmental

             55      Quality has made a draft permit available for public comment as part of the

approval process;
             56          WHEREAS, the public comment period ends February 17, 2005; and  
}

  the operation plan was approved by the executive secretary of the Solid and Hazardous Waste Control Board on February 18, 2005 and this approval has an effective date of February 18, 2005; and      


Page 3, Lines 61 through 67:

             61          NOW, THEREFORE, BE IT RESOLVED by the Legislature, the Governor concurring
             62      therein, that Wasatch Regional Solid Waste Management Corporation and the School and
             63      Institutional Trust Lands Administration be granted approval to construct and operate a Class V
             64      commercial nonhazardous solid waste landfill known as Wasatch Regional Solid Waste
             65      Landfill
{   , but only subject to and contingent upon the Department of Environmental Quality

             66      having granted final approval for and issuing the permit for the landfill on or before July 1,
             67      2005  
}

    The motion passed with Sen. Stephenson and Sen. Hillyard absent for the vote.

    Sen. Allen presented the bill to the committee.

     MOTION: Sen. Allen moved to pass SCR 2, as amended, out of committee with a     favorable recommendation.

    The motion passed with Sen. Stephenson and Sen. Hillyard absent for the vote.

3.     S.B. 225 CHANGES TO GENERAL GOVERNMENT - SALES AND USE TAX AMENDMENTS (Sen. G. Davis)

    Sen. Davis presented the bill to the committee.

    Brian Clifton, Motion Picture Association, spoke to the bill.

     MOTION: Sen. Allen moved to pass S.B. 225 out of committee with a favorable     recommendation.



    The motion passed unanimously with Sen. Bell absent for the vote.

4.    S.B. 211 FUNDING FOR CONVENTION FACILITIES (Sen. M. Waddoups)

    MOTION:
Sen. Hillyard moved to substitute S.B.211with 1st Sub. S.B. 211.

    The motion passed unanimously with Sen. Bell absent for the vote.

    Sen. Waddoups presented the bill to the committee.

    Allyson Jackson, Salt Palace/South Town, and Alan Dayton, Salt Lake County , spoke     to the bill.

     MOTION: Sen. Allen moved to amend 1st. Sub. S.B. 211 as follows:

    Page 8, Line 212:    After "county" delete "of the first class" and
        insert "having a population of over 100,000"
        
    
     SUB - MOTION: Sen. Hillyard moved to amend 1st. Sub. S.B. 211 as follows:     
     Page 8, Line 212:        After "county" delete "of the first class" and insert "having a population of over 75,000"

    The substitute motion passed unanimously with Sen. Bell and Sen. Dmitrich absent for the vote.

     Dave Buhler, Salt Lake City Council; Brent Gardner, Association of Counties; Clint     Ensign, Sinclair Oil Company, spoke in favor of the bill.
    Jani Iwamoto, Citizen; Karie Minaga-Miya, Citizen; Al Kubota, Citizen;     Rev. Patricia Alexander, Japanese Church of Christ, and Raymond Uno, Citizen, spoke     to the bill.
    Steve White, Utah County Commissioner, spoke in opposition.
    
     MOTION: Sen. Peterson moved to pass 1st Sub. S. B. 211, as amended, out of     committee with a favorable recommendation.

    The motion passed unanimously with Sen Dmitrich and Sen. Stephenson absent for the     vote.

    Sen. Peterson assumed the Committee Chair.

5.     S.B. 170 STATE TAX COMMISSION COLLECTION AND LICENSING     PRACTICES ( Sen. C. Bramble)

    
Sen. Bramble presented the bill to the committee.

     Rod Morrelli, Utah State Tax Commission, and Ruland Gill, Questar, spoke to the bill.
    

     MOTION: Sen. Bramble moved to pass S.B. 170 out of committee with a favorable     recommendation.

    The motion passed unanimously with Sen. Dmitrich, Sen. Stephenson and Sen. Hillyard     absent for the vote.

6.    S.B. 63 SEVERANCE TAX AMENDMENTS (Sen. B. Evans)

    MOTION:
Sen. Peterson moved to pass S.B. 63 out of committee with a favorable     recommendation.

    The motion pass unanimously with Sen. Dmitrich, Sen. Stephenson and Sen. Hillyard     absent for the vote.

7.    S.B. 209 INTERLOCAL COOPERATION ACT AMENDMENTS (Sen. C.     Bramble)

    
S.B. 209 was not considered.     
               MOTION: Sen. Bell moved to adjourn.

    The motion passed unanimously with Sen. Dmitrich, Sen. Stephenson and Sen. Hillyard     absent for the vote.     

    Sen. Bramble adjourned the meeting at 5:05 p.m.
