Committee Chair Killpack called the meeting to order at 8:05 a.m. and announced that S.B. 108
will be heard on Friday, January 21.
1. S.B. 37 Motor Vehicle Business Regulation Act Amendments (D. Eastman)
Sen. Eastman presented the bill and distributed the following amendments:
1. Page 1, Line 26 :
26 certificate of title or manufacturer's certificate of origin;

and
}
. provides that the surety or principal of a bond shall notify the administrator
of the Motor Vehicle Enforcement Division if a claim on the bond is successfully
prosecuted or settled against the surety or the principal; and
2. Page 3, Lines 62 through 67 :
62 (2)
(a)
A cause of action under Subsection (1) may not be maintained against a
surety
63 unless:

(a)
}
(i)
a claim is filed in writing with the administrator within one year
after the cause of
65 action arose; and

(b)
}
(ii)
the action is commenced within two years after the claim was
filed with the
67 administrator.
(b) The surety or principal shall notify the administrator if a claim on the bond
is successfully prosecuted or settled against the surety or principal.
MOTION: Sen. Mayne moved to adopt the amendments.
The motion passed unanimously with Sen. Bramble absent for the vote.
Sen. Eastman explained the bill assisted by Wayne Jones, State Tax Commission, and answered questions from the committee.
Craig Bickmore, Utah Auto Dealers Assn., spoke in support of the bill.
MOTION: Sen. Walker moved to pass the bill out favorably as amended.
The motion passed unanimously.
Sen. Walker assumed the Committee Chair.
2. S.B. 8 Local Corridor Preservation Funding (S. Killpack)
Sen. Killpack presented the bill and 1st Sub. S.B. 8 was distributed.
MOTION: Sen. Hale moved to adopt 1st Sub. S.B. 8.
The motion passed unanimously with Sen Bramble absent for the vote.
Sen. Killpack explained the bill and answered questions from the committee.
Rod Marrelli, Tax Commission, further clarified the bill.
Linda Hull, UDOT, spoke in support of the bill.
MOTION: Sen. Hale moved to pass the bill out favorably.
The motion passed unanimously with Sen. Bramble absent for the vote.
Sen. Killpack resumed the Committee Chair.
MOTION: Sen. Walker moved to adjourn.
The motion passed unanimously at 8:40 a.m. with Sen. Bramble absent for the vote .
