CHANGES IN TASK FORCE MEMBERSHIP

             6      LONG TITLE
             7      General Description:
             8          This bill modifies membership requirements for the Highway Jurisdictional Transfer
             9      Task Force, the Government Records Access and Management Task Force, the Tax
             10      Reform Task Force, and the Tourism Task Force.
             11      Highlighted Provisions:
             12          This bill:
             13          .    increases the number of members assigned to and modifies the requirements for the
             14      selection of members from the House of Representatives for the Highway
             15      Jurisdictional Transfer Task Force, the Government Records Access and
             16      Management Task Force, the Tax Reform Task Force, and the Tourism Task Force.
             17      Monies Appropriated in this Bill:

             20          This bill provides an effective date.

             28      Be it enacted by the Legislature of the state of Utah:
             29          Section 1. Uncodified Section 1, Chapter 194, Laws of Utah 2005 is amended to
             30      read:
             31          Section 1. Tax Reform Task Force -- Creation -- Membership -- Quorum --
             32      Compensation -- Staff.
             33          (1) There is created the Tax Reform Task Force consisting of the following [13] 15
             34      members:
             35          (a) four members of the Senate appointed by the president of the Senate, no more than
             36      three of whom may be from the same political party;
             37          (b) [seven] nine members of the House of Representatives appointed by the speaker of
             38      the House of Representatives, no more than [five] seven of whom may be from the same
             39      political party; and
             40          (c) two members appointed by the governor.
             41          (2) (a) The president of the Senate shall designate a member of the Senate appointed
             42      under Subsection (1)(a) as a cochair of the task force.
             43          (b) The speaker of the House of Representatives shall designate a member of the House
             44      of Representatives appointed under Subsection (1)(b) as a cochair of the task force.
             45          (3) A majority of the members of the task force constitute a quorum. The action of a
             46      majority of a quorum constitutes the action of the task force.
             47          (4) (a) Salaries and expenses of the members of the task force who are legislators shall
             48      be paid in accordance with Section 36-2-2 and Legislative Joint Rule 15.03.
             49          (b) A member of the task force who is not a legislator may not receive compensation
             50      for the member's work associated with the task force, but may receive per diem and
             51      reimbursement for travel expenses incurred as a member of the task force at the rates
             52      established by the Division of Finance under Sections 63A-3-106 and 63A-3-107 .
             53          (5) The Office of Legislative Research and General Counsel shall provide staff support
             54      to the task force.
             55          Section 2. Uncodified Section 1, Chapter 218, Laws of Utah 2005 is amended to
             56      read:


             57          Section 1. Tourism Task Force -- Creation -- Membership -- Quorum --
             58      Compensation -- Staff.
             59          (1) There is created the Tourism Task Force consisting of the following [12] 14
             60      members:
             61          (a) five members of the Senate appointed by the president of the Senate, no more than
             62      three of whom may be from the same political party; and
             63          (b) [seven] nine members of the House of Representatives appointed by the speaker of
             64      the House of Representatives, no more than [four] six of whom may be from the same political
             65      party.
             66          (2) (a) The president of the Senate shall designate a member of the Senate appointed
             67      under Subsection (1)(a) as a cochair of the task force.
             68          (b) The speaker of the House of Representatives shall designate a member of the House
             69      of Representatives appointed under Subsection (1)(b) as a cochair of the task force.
             70          (3) In conducting its business, the task force shall comply with the rules of legislative
             71      interim committees.
             72          (4) Salaries and expenses of a member of the task force who is a legislator shall be paid
             73      in accordance with Section 36-2-2 and Legislative Joint Rule 15.03.
             74          (5) The Office of Legislative Research and General Counsel shall provide staff support
             75      to the task force.
             76          Section 3. Uncodified Section 1, Chapter 224, Laws of Utah 2005 is amended to
             77      read:
             78          Section 1. Government Records Access and Management Task Force -- Creation
             79      -- Membership -- Interim rules followed -- Compensation -- Staff.
             80          (1) There is created the Government Records Access and Management Task Force
             81      consisting of the following [12] 14 members:
             82          (a) five members of the Senate appointed by the president of the Senate, no more than
             83      three of whom may be from the same political party; and
             84          (b) [seven] nine members of the House of Representatives appointed by the speaker of
             85      the House of Representatives, no more than [four] six of whom may be from the same political
             86      party.
             87          (2) (a) The president of the Senate shall designate a member of the Senate appointed


             88      under Subsection (1)(a) as a cochair of the task force.
             89          (b) The speaker of the House of Representatives shall designate a member of the House
             90      of Representatives appointed under Subsection (1)(b) as a cochair of the task force.
             91          (3) In conducting its business, the task force shall comply with the rules of legislative
             92      interim committees.
             93          (4) Salaries and expenses of the members of the task force shall be paid in accordance

             97          Section 4. Uncodified Section 16, Chapter 245, Laws of Utah 2005 is amended to
             98      read:
             99          Section 16. Highway Jurisdictional Transfer Task Force -- Creation --
             100      Membership -- Procedures -- Compensation -- Staff.
             101          (1) There is created the Highway Jurisdictional Transfer Task Force consisting of the
             102      following [13] 14 members:
             103          (a) three members of the Senate appointed by the president of the Senate, no more than
             104      two of whom may be from the same political party;
             105          (b) [three] four members of the House of Representatives appointed by the speaker of
             106      the House of Representatives, no more than [two] three of whom may be from the same
             107      political party;
             108          (c) the executive director or the executive director's designee of the Department of
             109      Transportation as a nonvoting member;
             110          (d) two representatives of metropolitan planning organizations as defined under
             111      Section 72-1-208.5 appointed by the governor as nonvoting members;
             112          (e) two representatives of the counties appointed by the governor as nonvoting
             113      members; and
             114          (f) two representatives of the municipalities appointed by the governor as nonvoting
             115      members.
             116          (2) (a) The president of the Senate shall designate a member of the Senate appointed
             117      under Subsection (1)(a) as a cochair of the task force.
             118          (b) The speaker of the House of Representatives shall designate a member of the House


             119      of Representatives appointed under Subsection (1)(b) as a cochair of the task force.
             120          (3) (a) A majority of the voting members of the task force constitutes a quorum of the
             121      task force.
             122          (b) The action of a majority of the voting members constitutes the action of the task
             123      force.
             124          (4) (a) Salaries and expenses of the members of the task force who are legislators shall
             125      be paid in accordance with Section 36-2-2 and Legislative Joint Rule 15.03.
             126          (b) A member of the task force who is not a legislator may not receive compensation
             127      for the work associated with the task force, but may receive per diem and reimbursement for
             128      travel expenses incurred as a member of the task force at the rates established by the Division
             129      of Finance under Sections 63A-3-106 and 63A-3-107 .
             130          (5) The Office of Legislative Research and General Counsel shall provide staff support

             132          (6) The Office of Legislative Fiscal Analyst shall provide staff for fiscal planning
             133      support to the task force.
             134          Section 5. Effective date.
             135          If approved by two-thirds of all the members elected to each house, this bill takes
             136      effect:
             137          (1) May 2, 2005, if the governor signs the bill before May 2, 2005; or
             138          (2) if the governor does not sign the bill before May 2, upon approval by the governor,
             139      or the day following the constitutional time limit of Utah Constitution Article VII, Section 8,
             140      without the governor's signature, or in the case of veto, the date of veto override.
