             7      LONG TITLE
             8      General Description:
             9          This bill modifies the Transportation Code by amending provisions relating to
             10      cooperation with metropolitan planning organizations.
             11      Highlighted Provisions:
             12          This bill:
             13          .    provides that a metropolitan planning organization is a governmental entity that is
             14      eligible to receive employment information from the Unemployment Insurance
             15      Division for the purpose of preparing transportation plans; and
             16          .    specifies the information that may be obtained by a metropolitan planning
             17      organization.

             24          72-1-208.5, as enacted by Chapter 31, Laws of Utah 2004
             26      Be it enacted by the Legislature of the state of Utah:
             27          Section 1. Section 72-1-208.5 is amended to read:
             28           72-1-208.5. Definition -- Cooperation with metropolitan planning organizations --
             29      Cooperation in plans and programs required.

             30          (1) As used in this section, "metropolitan planning organization" means an
             31      organization established under 23 U.S.C. Sec. 134.
             32          (2) The department shall cooperate with a metropolitan planning organization in the
             33      metropolitan planning organization's responsibility to carry out a continuing, cooperative, and
             34      comprehensive process for transportation planning and project programming.
             35          (3) If a metropolitan planning organization has a contiguous boundary with another
             36      metropolitan planning organization, the department shall cooperate with those organizations if
             37      the metropolitan planning organizations have:
             38          (a) coordinated project priorities, transportation plans, and transportation improvement
             39      programs; and
             40          (b) submitted joint priorities, plans, and programs to the department as comprehensive,
             41      integrated transportation plans.
             42          (4) Subject to the provisions of 23 U.S.C. Sec. 134, if the governor and the affected
             43      local units of government jointly determine that metropolitan planning organizations have
             44      failed to meet the guidelines under Subsection (3), the governor and local units of government
             45      may redesignate or realign the metropolitan planning organizations.
             46          (5) (a) A metropolitan planning organization is a governmental agency that is eligible
             47      to receive employment information from the Unemployment Insurance Division in accordance
             48      with Subsection 35A-4-312 (5)(d) for the purpose of preparing transportation plans as required
             49      by 23 U.S.C. Sec. 134.
             50          (b) Information obtained under Subsection (5)(a) is limited to the employer's:
             51          (i) name;
             52          (ii) worksite address;
             53          (iii) industrial classification; and
             54          (iv) number of employees.
