             8      General Description:
             9          This bill provides a cap on the annual appropriation of certain tax revenues to higher
             10      education.
             11      Highlighted Provisions:
             12          This bill:
             13          .    provides definitions;
             14          .    provides a minimum percentage of education revenues that shall be appropriated to
             15      the state system of public education; and
             16          .    provides a maximum percentage of education revenues that may be appropriated to
             17      the state's higher education system.

             24          53A-16-113, Utah Code Annotated 1953

             26      Be it enacted by the Legislature of the state of Utah:
             27          Section 1. Section 53A-16-113 is enacted to read:



             28          53A-16-113. Education revenue -- Cap on appropriations to higher education.
             29          (1) As used in this section, "education revenue" means all revenue received under Utah
             30      Constitution, Article XIII, Section 5, from taxes on intangible property or from a tax on
             31      income.
             32          (2) A minimum of 90% of education revenue shall annually be appropriated to support
             33      the state system of public education.
             34          (3) A maximum of 10% of education revenue may annually be appropriated to the
             35      state's higher education system.
