             8      General Description:
             9          This bill modifies the Public Employees' Benefit and Insurance Program Act by
             10      specifying an optional health plan that shall be offered to state elected officials.
             11      Highlighted Provisions:
             12          This bill:
             13          .    defines state elected officials;
             14          .    provides that beginning January 1, 2007, the Public Employees' Benefit and
             15      Insurance Program (PEHP), for a state elected official only, shall offer an optional
             16      high deductible health plan with a federally qualified health savings account; and
             17          .    requires the high deductible health plan to include a health savings account for each
             18      covered individual with certain contributions made by the employer.

             27      Be it enacted by the Legislature of the state of Utah:


             28          Section 1. Section 49-20-410 is enacted to read:
             29          49-20-410. High deductible health plan for state elected officials -- Health savings
             30      account -- Contributions.
             31          (1) As used in this section, "state elected official" means:
             32          (a) the governor;
             33          (b) the lieutenant governor;
             34          (c) the attorney general;
             35          (d) the state treasurer;
             36          (e) the state auditor; and
             37          (f) a member of the Legislature.
             38          (2) (a) Beginning January 1, 2007, in addition to other employee benefit plans offered
             39      under this part, for a state elected official only, the program shall offer a high deductible health
             40      plan with a federally qualified health savings account as an optional health plan.
             41          (b) The provisions and limitations of the plan shall be determined by the program in
             42      accordance with federal requirements and limitations.
             43          (3) (a) The program may not allow a state elected official to change from the high
             44      deductible health plan to another health plan offered for state elected officials more frequently
             45      than every three years.
             46          (b) The program shall offer the federally qualified health savings account for medical
             47      expenses for each covered individual in the high deductible health plan under this section.
             48          (4) (a) Contributions to the health savings account shall be made by the state.
             49          (b) The amount of the contributions under Subsection (3)(a) shall be determined
             50      annually by the program, after consultation with the Department of Human Resource
             51      Management and the Governor's Office of Planning and Budget, based on:
             52          (i) federal requirements and limitations; and
             53          (ii) the actuarial value of the risk-adjusted high deductible to the program.
             54          (c) A state elected official may also make contributions to the health savings account.
