             7      LONG TITLE
             8      General Description:
             9          This bill modifies provisions related to public library development within the state.
             10      Highlighted Provisions:
             11          This bill:
             12          .    provides that the State Library Board shall provide state funds to libraries that
             13      comply with standards developed by the board for public libraries, apportioned on a
             14      basis determined by the board; and
             15          .    makes certain technical changes.
             16      Monies Appropriated in this Bill:
             17          This bill appropriates:
             18          .    as an ongoing appropriation subject to future budget constraints, $437,000 from the
             19      General Fund to the State Library Division within the Department of Community
             20      and Culture to be used by the State Library Board for public library development
             21      grants.
             22      Other Special Clauses:
             23          This bill takes effect July 1, 2006.

             28      Be it enacted by the Legislature of the state of Utah:
             29          Section 1. Section 9-7-205 is amended to read:
             30           9-7-205. Duties of board and director.
             31          (1) The board shall:
             32          (a) promote, develop, and organize a state library and make provisions for its housing;
             33          (b) promote and develop library services throughout the state in cooperation with [any
             34      and all] other state or municipal libraries, schools, or other agencies [wherever practical];
             35          (c) promote the establishment of district, regional, or multicounty libraries as
             36      conditions within particular areas of the state may require;
             37          (d) supervise the books and materials of the state library and require the keeping of
             38      careful and complete records of the condition and affairs of the state library [to be kept];
             39          (e) establish policies for the administration of the division and for the control,
             40      distribution, and lending of books and materials to those libraries, institutions, groups, or
             41      individuals entitled to them under this chapter;
             42          (f) serve as the agency of the state for the administration of any state or federal funds
             43      that may be appropriated to further library development within the state;
             44          (g) aid and provide general advisory assistance in the development of statewide school
             45      library service and encourage contractual and cooperative relations between school and public
             46      libraries;
             47          (h) give assistance, advice, and counsel to all tax-supported libraries of any type within
             48      the state and to all communities or persons proposing to establish them and conduct courses
             49      and institutes on the approved methods of operation, selection of books, or other activities
             50      necessary to the proper administration of a library;
             51          (i) furnish or contract for the furnishing of library or information service to state
             52      officials, state departments, or any groups that in the opinion of the director warrant the
             53      furnishing of those services, particularly through the facilities of traveling libraries to those
             54      parts of the state otherwise inadequately supplied by libraries;
             55          (j) where sufficient need exists and if the director considers it advisable, establish and
             56      maintain special departments in the state library to provide services for the blind, visually
             57      impaired, persons with disabilities, and professional, occupational, and other groups;
             58          (k) administer a depository library program by collecting state publications, and


             59      providing a bibliographic information system;
             60          (l) require that information and statistics necessary to the work of the state library be
             61      collected, and that findings and reports be published;
             62          (m) make any report concerning the activities of the state library to the governor as [he]
             63      the governor may require; and
             64          (n) develop standards for public libraries and provide state funds to libraries that
             65      comply with those standards, apportioned on a basis determined by the board.
             66          (2) The director shall, under the policy direction of the board, carry out the
             67      responsibilities under Subsection (1).
             68          Section 2. Appropriation.
             69          As an ongoing appropriation subject to future budget constraints, there is appropriated
             70      from the General Fund for fiscal year 2006-07, $437,000 to the State Library Division within
             71      the Department of Community and Culture to be used by the State Library Board for public
             72      library development grants under Subsections 9-7-205 (f) and (n).
             73          Section 3. Effective date.
             74          This bill takes effect July 1, 2006.
