7 LONG TITLE
8 General Description:
9 This bill creates and appropriates money for a beginning teacher induction program.
10 Highlighted Provisions:
11 This bill:
12 . creates the Beginning Teacher Induction Program to improve teacher performance
13 and increase the retention of effective teachers;
14 . specifies requirements for school districts and charter schools to receive monies for
15 their beginning teacher induction programs;
16 . specifies how Beginning Teacher Induction Program monies shall be distributed to
17 school districts and charter schools;
18 . appropriates money for the Beginning Teacher Induction Program;
19 . directs the State Board of Education to make rules; and
20 . modifies professional requirements of mentors.
21 Monies Appropriated in this Bill:
22 This bill appropriates:
23 . as an ongoing appropriation subject to future budget constraints, $4,200,000 from
24 the Uniform School Fund for fiscal year 2006-07 to the State Board of Education
25 for the Beginning Teacher Induction Program.
26 Other Special Clauses:
27 This bill takes effect on July 1, 2006.

34 Be it enacted by the Legislature of the state of Utah:
35 Section 1. Section 53A-10-108 is amended to read:
36 53A-10-108. Mentor for provisional educator.
37 (1) In accordance with Subsections 53A-1a-104 (7) and 53A-6-102 (2)(a) and (b), the
38 principal or [
39 provisional educator.
40 (2) Where possible, the mentor shall be a career educator who [
41
42 experience and:
43 (a) performs substantially the same duties as the provisional educator; or
44 (b) is assigned as a mentor on a full or part-time basis.
45 (3) The mentor shall assist the provisional educator to become effective and competent
46 in the teaching profession and school system, but may not serve as an evaluator of the
47 provisional educator.
48 Section 2. Section 53A-10-108.5 is enacted to read:
49 53A-10-108.5. Beginning Teacher Induction Program.
50 (1) As used in this section:
51 (a) "Board" means the State Board of Education.
52 (b) "Consortium" means two or more school districts, charter schools, or both, that
53 jointly develop and implement a beginning teacher induction plan.
54 (c) "Level 1 teacher" means a teacher who holds a Level 1 license as defined in Section
55 53A-6-103 .
56 (2) The Beginning Teacher Induction Program is created to:
57 (a) improve teacher performance; and
58 (b) increase the retention of effective teachers.
59 (3) Subject to future budget constraints, the Legislature may annually appropriate
60 money to the board for the Beginning Teacher Induction Program.
61 (4) School districts, charter schools, and consortiums may apply to the board for money
62 to:
63 (a) implement a beginning teacher induction program; or
64 (b) continue and improve an existing beginning teacher induction program.
65 (5) (a) To apply for Beginning Teacher Induction Program monies, a school district,
66 charter school, or consortium shall submit a plan to the board for a beginning teacher induction
67 program to be implemented by the district, school, or consortium.
68 (b) Each applicant shall include within the applicant's plan:
69 (i) measurable goals consistent with the purpose of the Beginning Teacher Induction
70 Program as specified in Subsection (2); and
71 (ii) methods and instruments to evaluate the district's, school's, or consortium's
72 beginning teacher induction program, such as:
73 (A) student test scores;
74 (B) evaluations of provisional educators as required by Section 53A-10-104 ; or
75 (C) data on teacher retention or attrition.
76 (c) A school district or charter school submitting an application for Beginning Teacher
77 Induction Program monies to continue an existing beginning teacher induction program shall
78 include with its application evidence demonstrating the effectiveness of the program.
79 (6) (a) The board shall develop model beginning teacher induction plans consistent
80 with this section, Section 53A-10-108 , and board rules that may be adopted by a school district,
81 charter school, or consortium.
82 (b) A school district, charter school, or consortium may develop its own plan that is
83 consistent with this section, Section 53A-10-108 , and board rules.
84 (7) (a) The board may approve, disapprove, or recommend modifications to a
85 beginning teacher induction plan.
86 (b) A school district, charter school, or consortium shall receive program monies if the
87 board approves the plan.
88 (8) Beginning Teacher Induction Program monies shall be awarded based on the
89 number of Level 1 teachers employed by the school district, charter school, or consortium
90 members.
91 (9) A school district, charter school, or consortium shall use Beginning Teacher
92 Induction Program monies to implement its beginning teacher induction plan.
93 (10) To receive continued funding for beginning teacher induction programs, a school
94 district, charter school, or consortium shall annually submit:
95 (a) an evaluation of the program's effectiveness in achieving the measurable program
96 goals; and
97 (b) revisions to the plan based upon the evaluation data to further improve teacher
98 performance and increase the retention of effective teachers.
99 (11) The board may not approve a plan and distribute Beginning Teacher Induction
100 Program monies to any school district, charter school, or consortium that after three years has
101 not demonstrated substantial success in improving teacher performance and retention.
102 (12) The board may make rules to administer this section in accordance with Title 63,
103 Chapter 46a, Utah Administrative Rulemaking Act.
104 Section 3. Appropriation.
105 As an ongoing appropriation subject to future budget constraints, there is appropriated
106 from the Uniform School Fund for fiscal year 2006-07, $4,200,000 to the State Board of
107 Education for the Beginning Teacher Induction Program created in Section 53A-10-108.5 .
108 Section 4. Effective date.
109 This bill takes effect on July 1, 2006.
