8 LONG TITLE
9 General Description:
10 This bill modifies the Public Employees' Benefit and Insurance Program Act by
11 amending provisions of the health plans offered by the program.
12 Highlighted Provisions:
13 This bill:
14 . requires the Public Employees' Benefit and Insurance Program (PEHP) to offer a
15 high deductible health plan with a federally qualified health reimbursement
16 arrangement;
17 . prohibits the program from allowing an employee to change from the high
18 deductible health plan to another health plan more frequently than every three years;
19 and
20 . requires the high deductible health plan to include a health reimbursement
21 arrangement for each covered individual with certain contributions made by the
22 employer.

31 Be it enacted by the Legislature of the state of Utah:
32 Section 1. Section 49-20-410 is enacted to read:
33 49-20-410. High deductible health plan -- Health reimbursement arrangement --
34 Contributions.
35 (1) (a) In addition to other employee benefit plans offered under this part, the program
36 shall offer a high deductible health plan with a federally qualified health reimbursement
37 arrangement as an optional health plan.
38 (b) The provisions and limitations of the plan shall be determined by the program in
39 accordance with federal requirements and limitations.
40 (2) (a) The program may not allow an employee to change from the high deductible
41 health plan to another health plan offered for employees more frequently than every three years.
42 (b) The program shall offer the federally qualified health reimbursement arrangement
43 for medical expenses for each covered individual in the high deductible health plan.
44 (3) (a) Contributions to the health reimbursement arrangement shall be made by the
45 employer.
46 (b) The amount of the contributions under Subsection (3)(a) shall be determined
47 annually by the program, after consultation with the Department of Human Resource
48 Management and the Governor's Office of Planning and Budget, based on:
49 (i) federal requirements and limitations; and
50 (ii) the actuarial value of the risk-adjusted high deductible to the program.
