8 LONG TITLE
9 General Description:
10 This bill modifies the Motor Vehicles Code and the Community and Culture Code by
11 creating a Native American special group license plate supporting Native American
12 scholarships.
13 Highlighted Provisions:
14 This bill:
15 . creates a special group license plate for individuals who contribute to Native
16 American scholarships through the Division of Indian Affairs;
17 . requires an applicant for a Native American plate to make a $25 annual donation to
18 the Division of Indian Affairs for Native American Scholarships;
19 . creates the Native American Scholarship Restricted Account;
20 . requires the Division of Indian Affairs to:
21 . make rules governing the application for monies and distribution of monies
22 received into the account; and
23 . distribute contributions received into the account; and
24 . makes technical changes.

27 Other Special Clauses:
28 This bill takes effect on October 1, 2006.

37 Be it enacted by the Legislature of the state of Utah:
38 Section 1. Section 9-9-104 is amended to read:
39 9-9-104. Duties and powers.
40 (1) The division shall:
41 (a) have all of the functions, powers, duties, rights, and responsibilities granted to it by
42 this chapter;
43 (b) staff those committees or boards as specified in this chapter; [
44 (c) in accordance with policies set by state government, coordinate relations between:
45 (i) the state;
46 (ii) tribal governments;
47 (iii) other Indian groups; and
48 (iv) federal agencies[
49 (d) distribute contributions to the Native American Scholarship Restricted Account
50 created in Section 9-9-112 in accordance with rules made by the division under Subsection
51 9-9-112 (5).
52 (2) The division may:
53 (a) contract with public and private entities to provide services or facilities;
54 (b) acquire and hold funds or other property for the administration of the programs
55 outlined in this chapter;
56 (c) make rules in accordance with Title 63, Chapter 46a, Utah Administrative
57 Rulemaking Act, that are necessary to carry out the duties of the division;
58 (d) accept gifts, grants, devises, and property, in cash or in kind, for the benefit of
59 Indians; and
60 (e) apply or dispose of those gifts, grants, devises, and property received under
61 Subsection (2)(d) for the use and benefit of Indians within the state.
62 Section 2. Section 9-9-112 is enacted to read:
63 9-9-112. Native American Scholarship Restricted Account -- Creation -- Funding
64 -- Distribution of funds by the Division of Indian Affairs.
65 (1) There is created in the General Fund a restricted account known as the Native
66 American Scholarship Restricted Account.
67 (2) The account shall be funded by:
68 (a) contributions deposited into the Native American Scholarship Restricted Account
69 in accordance with Section 41-1a-422 ;
70 (b) private contributions;
71 (c) donations or grants from public or private entities; or
72 (d) interest and earnings on account monies.
73 (3) Funds in the account are nonlapsing.
74 (4) The Legislature shall appropriate money in the account to the division.
75 (5) In accordance with Title 63, Chapter 46a, Utah Administrative Rulemaking Act, the
76 division shall make rules providing procedures for an individual to apply to receive funds from
77 the account including:
78 (a) applicant qualifications;
79 (b) application procedures; and
80 (c) institutional qualifications.
81 Section 3. Section 41-1a-418 is amended to read:
82 41-1a-418. Authorized special group license plates.
83 (1) The division shall only issue special group license plates in accordance with
84 Sections 41-1a-418 through 41-1a-422 to a person who is specified under this section within
85 the categories listed as follows:
86 (a) disability special group license plates issued in accordance with Section 41-1a-420 ;
87 (b) honor special group license plates, as in a war hero, which plates are issued for a:
88 (i) survivor of the Japanese attack on Pearl Harbor;
89 (ii) former prisoner of war;
90 (iii) recipient of a Purple Heart; or
91 (iv) disabled veteran;
92 (c) unique vehicle type special group license plates, as for historical, collectors value,
93 or other unique vehicle type, which plates are issued for a:
94 (i) special interest vehicle;
95 (ii) vintage vehicle;
96 (iii) farm truck; or
97 (iv) vehicle powered by clean fuel and for which a current clean special fuel certificate
98 is maintained as provided in Section 59-13-304 ;
99 (d) recognition special group license plates, as in a public official or an emergency
100 service giver, which plates are issued for a:
101 (i) current member of the Legislature;
102 (ii) current member of the United States Congress;
103 (iii) current member of the National Guard;
104 (iv) licensed amateur radio operator;
105 (v) currently employed, volunteer, or retired firefighter;
106 (vi) emergency medical technician;
107 (vii) current member of a search and rescue team; or
108 (viii) current honorary consulate designated by the United States Department of State;
109 and
110 (e) support special group license plates, as for a contributor to an institution or cause,
111 which plates are issued for a contributor to:
112 (i) an institution's scholastic scholarship fund;
113 (ii) the Division of Wildlife Resources;
114 (iii) the Office of Veterans' Affairs;
115 (iv) the Division of Parks and Recreation;
116 (v) the Department of Agriculture and Food;
117 (vi) the Guardian Ad Litem Services Account and the Children's Museum of Utah;
118 (vii) the Boy Scouts of America;
119 (viii) spay and neuter programs through No More Homeless Pets in Utah;
120 (ix) the Boys and Girls Clubs of America; [
121 (x) Utah public education[
122 (xi) Native American scholarships through the Division of Indian Affairs.
123 (2) Beginning January 1, 2003, the division may not issue a new type of special group
124 license plate unless the division receives:
125 (a) a start-up fee established under Section 63-38-3.2 for production and administrative
126 costs for providing the new special group license plates; or
127 (b) a legislative appropriation for the start-up fee provided under Subsection (2)(a).
128 (3) (a) A sponsoring organization that qualifies for tax-exempt status under Internal
129 Revenue Code Section 501(c)(3) may request the commission to authorize a new type of
130 special group license plate for the sponsoring organization. The sponsoring organization shall:
131 (i) collect a minimum of 200 applications; and
132 (ii) pay a start-up fee established under Section 63-38-3.2 for production and
133 administrative costs for providing the new type of special group license plates.
134 (b) If the provisions of Subsection (3)(a) are met, the commission shall approve the
135 request and the division shall:
136 (i) design a license plate in accordance with Section 41-1a-419 ; and
137 (ii) issue the new type of special group license plates.
138 Section 4. Section 41-1a-422 is amended to read:
139 41-1a-422. Support special group license plates -- Contributor -- Voluntary
140 contribution collection procedures.
141 (1) As used in this section:
142 (a) (i) Except as provided in Subsection (1)(a)(ii), "contributor" means a person who
143 has donated or in whose name at least $25 has been donated to:
144 (A) a scholastic scholarship fund of a single named institution;
145 (B) the Division of Veterans' Affairs in the Utah National Guard for veterans'
146 programs;
147 (C) the Division of Wildlife Resources for the Wildlife Resources Account created in
148 Section 23-14-13 , for conservation of wildlife and the enhancement, preservation, protection,
149 access, and management of wildlife habitat;
150 (D) the Department of Agriculture and Food for the benefit of soil conservation
151 districts;
152 (E) the Division of Parks and Recreation for the benefit of snowmobile programs;
153 (F) the Guardian Ad Litem Services Account and the Children's Museum of Utah, with
154 the donation evenly divided between the two;
155 (G) the Boy Scouts of America for the benefit of a Utah Boy Scouts of America
156 council as specified by the contributor;
157 (H) No More Homeless Pets in Utah for distribution to organizations or individuals
158 that provide spay and neuter programs that subsidize the sterilization of domestic animals;
159 (I) the Utah Alliance of Boys and Girls Clubs, Inc. to provide and enhance youth
160 development programs; [
161 (J) the Utah Association of Public School Foundations to support public education[
162 or
163 (K) the Division of Indian Affairs for the Native American Scholarship Restricted
164 Account created in Section 9-9-112 .
165 (ii) For a veterans' special group license plate, "contributor" means a person who has
166 donated or in whose name at least a $25 donation at the time of application and $10 annual
167 donation thereafter has been made.
168 (b) "Institution" means a state institution of higher education as defined under Section
169 53B-3-102 or a private institution of higher education in the state accredited by a regional or
170 national accrediting agency recognized by the United States Department of Education.
171 (2) (a) An applicant for original or renewal collegiate special group license plates under
172 Subsection (1)(a)(i) must be a contributor to the institution named in the application and
173 present the original contribution verification form under Subsection (2)(b) or make a
174 contribution to the division at the time of application under Subsection (3).
175 (b) An institution with a support special group license plate shall issue to a contributor
176 a verification form designed by the commission containing:
177 (i) the name of the contributor;
178 (ii) the institution to which a donation was made;
179 (iii) the date of the donation; and
180 (iv) an attestation that the donation was for a scholastic scholarship.
181 (c) The state auditor may audit each institution to verify that the moneys collected by
182 the institutions from contributors are used for scholastic scholarships.
183 (d) After an applicant has been issued collegiate license plates or renewal decals, the
184 commission shall charge the institution whose plate was issued, a fee determined in accordance
185 with Section 63-38-3.2 for management and administrative expenses incurred in issuing and
186 renewing the collegiate license plates.
187 (e) If the contribution is made at the time of application, the contribution shall be
188 collected, treated, and deposited as provided under Subsection (3).
189 (3) (a) An applicant for original or renewal support special group license plates under
190 this section must be a contributor to the sponsoring organization associated with the license
191 plate.
192 (b) This contribution shall be:
193 (i) unless collected by the named institution under Subsection (2), collected by the
194 division;
195 (ii) considered a voluntary contribution for the funding of the activities specified under
196 this section and not a motor vehicle registration fee; and
197 (iii) deposited into the appropriate account less actual administrative costs associated
198 with issuing the license plates.
199 (c) The donation described in Subsection (1)(a) must be made in the 12 months prior to
200 registration or renewal of registration.
201 (d) The donation described in Subsection (1)(a) shall be a one-time donation made to
202 the division when issuing original:
203 (i) snowmobile license plates; or
204 (ii) soil conservation license plates.
205 (4) Veterans' license plates shall display one of the symbols representing the Army,
206 Navy, Air Force, Marines, Coast Guard, or American Legion.
207 Section 5. Effective date.
208 This bill takes effect on October 1, 2006.
