             8      LONG TITLE
             9      General Description:
             10          This rules resolution defines "base budget" and establishes a process and deadlines for
             11      preparing, reviewing, and adopting base budget bills.
             12      Highlighted Provisions:
             13          This resolution:
             14          .    defines the term "base budget";
             15          .    requires the Executive Appropriations Committee to adopt base budgets in its
             16      presession December meeting; and
             17          .    requires any base budget bills to be available for legislator review at the time the
             18      Legislature convenes on the first day of the session and be passed by close of
             19      business on the tenth day but not before the third day of the session.

             28      Be it resolved by the Legislature of the state of Utah:
             29          Section 1. JR3-2-402 is amended to read:
             30           JR3-2-402. Executive Appropriations -- Duties.
             31          (1) As used in this rule, "base budget" means:
             32          (a) amounts appropriated by the Legislature for each item of appropriation for the
             33      current fiscal year that:
             34          (i) are not designated as one-time in an appropriation, regardless of whether or not the
             35      appropriations is covered by ongoing or one-time revenue sources; and
             36          (ii) were not vetoed by the governor, unless the Legislature overrode the veto; and
             37          (b) any changes to those amounts approved by the Executive Appropriations
             38      Committee.
             39          [(1)] (2) (a) The Executive Appropriations Committee shall meet no later than the third
             40      Wednesday in December to:
             41          (i) direct staff as to what revenue estimate to use in preparing budget
             42      recommendations;
             43          (ii) decide whether or not to set aside special allocations for the end of the session;
             44          (iii) approve the appropriate amount for each subcommittee to use in preparing its
             45      budget; [and]
             46          (iv) set a budget figure[.]; and
             47          (v) adopt base budgets and direct the Legislative Fiscal Analyst to prepare one or more
             48      appropriations acts appropriating base budgets for the next fiscal year.
             49          (b) The chairs of each appropriation subcommittee are invited to attend this meeting.
             50          [(2)] (3) Appropriations subcommittees may not meet while the Senate or House is in
             51      session without special leave from the Speaker of the House and the President of the Senate.
             52          [(3)] (4) All proposed items of expenditure to be included in the appropriations bills
             53      shall be submitted to one of the subcommittees named in JR3-2-302 for consideration and
             54      recommendation.
             55          [(4)] (5) (a) After receiving and reviewing subcommittee reports, the Executive
             56      Appropriations Committee may refer the report back to an appropriations subcommittee with


             57      any guidelines the Executive Appropriations Committee considers necessary to assist the
             58      subcommittee in producing a balanced budget.
             59          (b) The subcommittee shall meet to review the new guidelines and report the
             60      adjustments to the chairs of the Executive Appropriations Committee as soon as possible.
             61          [(5)] (6) (a) After receiving the reports, the Executive Appropriations Committee
             62      chairs will report them to the Executive Appropriations Committee.
             63          (b) That committee shall:
             64          (i) make any further adjustments necessary to balance the budget; and
             65          (ii) complete all decisions necessary to draft the final appropriations bill no later than
             66      the 38th day of the annual general session.
             67          Section 2. JR-19.07 is enacted to read:
             68          JR-19.07. Base Budget Bills.
             69          (1) Each legislator shall receive a copy of each base budget bill for the next fiscal year
             70      by calendared floor time on the first day of the annual general session.
             71          (2) By noon on the tenth day but not before the third day of the annual general session,
             72      the Legislature shall either pass or defeat each base budget bill.
