             9      General Description:
             10          This bill requires the Legislative Compensation Commission to make recommendations
             11      to the Legislature about legislative expenses and benefits.
             12      Highlighted Provisions:
             13          This bill:
             14          .    requires the Legislative Compensation Commission to make recommendations to
             15      the Legislature about legislative expenses and legislative benefits;
             16          .    requires the Legislative Compensation Commission to evaluate the time
             17      commitment and activities of legislators in performing their legislative
             18      responsibilities; and
             19          .    makes technical corrections.

             28      Be it enacted by the Legislature of the state of Utah:
             29          Section 1. Section 36-2-5 is amended to read:
             30           36-2-5. Duties of Legislative Compensation Commission.
             31          (1) The Legislative Compensation Commission [has the following duties: (1) It] shall:
             32          (a) by following the requirements of Subsection (2), study [and formulate
             33      recommendations concerning] the salary, expense, and benefit levels for Utah state legislators[.
             34      The study should be based upon];
             35          (b) by January 2 of each even-numbered year:
             36          (i) recommend to each member of the Legislature changes, if any, which should be
             37      made in the salary plan, the salary plan's administration, legislative expenses, and legislative
             38      benefits for state legislators; and
             39          (ii) as part of its recommendations, recite the provisions of Section 36-2-3 .
             40          (2) The commission shall:
             41          (a) ensure that the study and recommendations required by Subsection (1) are based
             42      upon:
             43          (i) maintaining a citizen Legislature in Utah[, but]; and
             44          (ii) compensating [members] legislators fairly for their service in order that all
             45      individuals [would] have an opportunity to serve[. Comparisons with salaries] in the Utah
             46      Legislature;
             47          (b) evaluate the time that legislators spend, and the activities that legislators engage in,
             48      in performing their legislative responsibilities and take that time and those activities into
             49      account in making recommendations for legislator compensation;
             50          (c) ensure that recommendations governing expenses are based upon:
             51          (i) payment of necessary expenses for attendance during legislative sessions;
             52          (ii) a mileage allowance; and
             53          (iii) reimbursement for other expenses involved in the performance of legislative
             54      duties;
             55          (d) ensure that the recommendations governing legislative benefits address:
             56          (i) retirement;


             57          (ii) death allowances;
             58          (iii) health insurance;
             59          (iv) life insurance;
             60          (v) post retirement health insurance; and
             61          (vi) other applicable benefits; and
             62          (e) in developing its recommendations, conduct and consider comparisons of salaries,
             63      expense reimbursements, and benefits of other similar state legislators and other [such] similar
             64      factors [should be considered in developing the recommendations. This study does not include
             65      a review of the appropriate expense level of legislators].
             66          [(2) The commission shall submit to each member of the Legislature, by January 2nd of
             67      each even-numbered year, recommendations concerning changes, if any, which should be made
             68      in the salary plan and its administration for state legislators. This recommendation shall
             69      include a recitation of the provisions of Section 36-2-3 .]
