Vice Chair Dunnigan called the meeting to order at 8:05 a.m.

MOTION:    Rep. Hansen moved to approve the minutes of the January 27, 2006 meeting. The motion passed unanimously, with Rep. Biskupski, Rep. D. Clark, Rep. Duckworth, Rep. Morley, Rep. Oda, and Rep. Wyatt absent for the vote.

H.B. 114    Minimum Enforcement of Food Sanitation Rules (Rep. S. Clark)

Rep. S. Clark introduced the bill to the committee, with the assistance of Kathy Froerer, Executive Director, Utah Association of Local Health Departments. (handout)

MOTION:    Rep. Oda moved to pass the bill out favorably. The motion passed unanimously, with Rep. D. Clark and Rep. Morley absent for the vote.


H.B. 92    Limitation of Physician Noncompetition Agreements (Rep. R. McGee)

Rep. McGee introduced the bill to the committee, with the assistance of Cathy Dupont, Office of Legislative Research and General Counsel. (handout)

MOTION:    Rep. Kiser moved to amend the bill as follows:

1.    Page 2, Lines 54 through 56 :    

             54          (A) the
{   actual   } costs of recruiting the physician as detailed in the contract, and up to      {   1/2   }        any earned portion      

             55      of the physician's first year salary if termination occurs within 24 months from the initial date
             56      of service;

2. Page 4, Lines 95 through 97

             95          (A) the
{   actual   } costs of recruiting the physician as detailed in the contract and up to      {   1/2   }        any earned portion      

             96      of the physician's first year salary if termination occurs within 24 months from the initial date
             97      of service;

The motion to amend passed unanimously.

Rep. Snow introduced the bill to the committee.

MOTION:    Rep. D. Clark moved to pass the bill out favorably. The motion passed unanimously.

MOTION:    Rep. Snow moved that H.B. 315 be placed in the Consent Calendar. The motion passed unanimously.
