Chair Dayton called the meeting to order at 2:18 pm and welcomed committee members with apologies for needing to begin late.

Rep. Moss gave a brief lesson on English grammar.


H.C.R. 2    Resolution Promoting Utah's Legislators Back to School Program (Rep. M. Dayton)

Rep. Dayton introduced Shelley Day, Office of Legislative Research and General Counsel, who explained that the Legislator's Back to School Program is now a year round program

Motion: Rep. Shurtliff moved to pass H.C.R. 2 with a favorable recommendation. The motion passed unanimously with Rep. Bigelow, Rep. Dougall, Rep. Ferrin, Rep. Holdaway, Rep. Hughes, and Rep. Urquhart absent.

Rep. Hogue made the motion to place H.C.R. 2 on the consent agenda. The motion passed unanimously with Rep. Dougal, Rep. Ferrin, Rep Holdaway, and Rep. Hughes absent.




Supt. Patti Harrington, State Superintendent, presented an update on No Child Left Behind.

H.B. 66    Tuition Waivers for Higher Education (Rep. C. Buttars)


Chair Dayton announced the bill would not be considered today

H.B. 232    Higher Education Tuition for Active Duty Military (Rep. M. Morley)


Rep. Morley explained the bill allows active duty military personnel to reestablish resident status at state institutions of higher education.

Motion: Rep. Hughes moved to pass the bill out favorably. The motion passed with Rep. Bigelow and Rep. Hughes voting in opposition. Absent were Rep. Dougall, Rep. Ferrin, Rep. Holdaway and Rep. Johnson.


H.B. 77    School District Boundaries (Rep. D. Cox)


Rep. Cox explained the bill modifies procedures for the creation of a new school district and requires school district boundary changes or new district creation so that all districts have less than a specified number of enrolled students.

Motion: Rep. Ferrin moved to amend the bill as follows:

Page 6, Line 152: After "petition" delete "submitted under Subsection (2)(a)(i)"

The motion passed unanimously. Absent were Rep. Holdaway and Rep. Johnson.

The following spoke in opposition to the bill:

Marilyn Kofford, Utah PTA
Steve Peterson, Utah School Boards Association and Utah Superintendents Association

Motion: Rep. Newbold moved to adjourn. The motion passed with Rep. Hogue, Rep. Holdaway, Rep. Bourdeaux, and Rep. Urquhart voting in opposition.

The meeting adjourned at 4:05 P.M.
