Chair Dayton called the meeting to order at 4:20 p.m.

Rep. Moss gave a brief lesson on English grammar.

MOTION:    Rep. Holdaway moved to approve the minutes of February 10, 2006. The motion passed unanimously with Rep. Johnson absent for the vote.

The chair indicated that items 1 and 6 would be switched on the agenda.

The Chair indicated that public input would be dependent upon time spent on questions from the committee members.

H.B. 172    Local Land Use Provisions Relating to Schools (Rep. J. Ferrin)

Rep. Ferrin presented the bill and reported that, as a contractor, he had a conflict of interest

relative to charter schools being built. The bill modifies county and municipal land use provisions applicable to schools and charter schools.

The following spoke in opposition to the bill:

MOTION:    Rep. Hughes moved to pass out HB172 with a favorable recommendation.

SUBSTITUTE
MOTION:    Rep. Holdaway moved to move to the next item on the agenda. The motion passed with Rep. Ferrin, Rep. Hughes, and Rep. Dayton voting in opposition. Rep. Bourdeaux and Rep. Johnson were absent for the vote.

H.J.R. 11    Resolution Urging Congress to Repeal No Child Left Behind (Rep. D. Cox)

MOTION:    Rep. Gowans moved to delete in title and body HJR 11 and replace it with 2nd Substitute HJR 11. The motion passed unanimously with Rep. Bourdeaux, Rep. Hogue, and Rep. Johnson absent for the vote.

Rep. Cox presented the resolution to the committee.

Speaking in favor of the bill were:

Steven Peterson, Utah School Boards and Utah Superintendents Association

MOTION:    Rep. Dougall moved to pass out 2nd Substitute H.J.R. 11 with a favorable recommendation.

SUBSTITUTE
MOTION:    Rep. Christensen moved to amend the bill as follows:

    A vote was taken on Rep. Dougall's motion. The motion to pass out favorably 2nd Substitute HJR 11 as amended passed with Rep. Bourdeaux voting in opposition, and Rep. Hogue, Rep. Johnson, and Rep. Shurtliff absent for the vote.


H.B. 155    Education Testing Amendments (Rep. N. Hansen)

MOTION:     Rep. Dougall moved to delete in title and body HB155 and replace it with 2nd Substitute HB 155. The motion passed unanimously with Rep. Hogue and Rep. Johnson absent for the vote.

Rep. Hansen presented the bill to the committee and explained the education testing requirement changes.

MOTION:    Rep. Shurtliff moved to approve 2nd Substitute HB155. The motion passed with Rep. Hughes voting in opposition and Rep. Dougall, Rep. Ferrin, Rep. Hogue, and Rep. Johnson absent for the vote.

H.B. 326    New Century Scholarship Amendments (Rep. K. Holdaway)


Rep. Holdaway explained the bill which modifies requirements to qualify for a New Century Scholarship.

MOTION:    Rep. Gowans moved to pass out HB 326 with a favorable recommendation. The motion passed unanimously with Rep. Dougall, Rep. Ferrin, Rep. Hogue, and Rep. Johnson absent for the vote.

MOTION:    Rep. Hughes moved to place HB 326 on the Consent Calendar. The motion passed unanimously with Rep. Dougall, Rep. Ferrin, Rep. Hogue, Rep. Johnson,

and Rep. Newbold absent for the vote.

Rep. Dayton relinquished the chair to Rep. Hughes.


S.B. 56    Secondary School Amendments (Sen. D. C. Buttars)

MOTION:    Rep. Dayton moved to delete in title and body SB 56 and replace it with 1st Substitute SB 56. The motion passed unanimously with Rep. Christensen, Rep. Dougall, Rep. Ferrin, Rep. Hogue, Rep. Johnson, and Rep. Newbold absent for the vote.

Rep. Dayton introduced the bill which specifies requirements for the acceptance of credits awarded by schools and establishes requirements for the Electronic High School.

The following spoke in opposition to the bill:

MOTION:    Rep. Hogue moved to move to the next item on the agenda. The motion passed with Rep. Newbold voting in opposition. Rep. Dougall, Rep. Ferrin, and Rep. Johnson were absent for the vote.
