Representative Ferrin called the meeting to order at 8:00 a.m.

MOTION:    Rep. Donnelson moved to approve the minutes of the January 18, 2006 meeting. The motion passed unanimously with Rep. McGee absent for the vote.


H.B. 249    Juvenile Court Judge (Rep. D. Hogue)

Rep. Hogue introduced H.B. 249 and explained it to the committee, assisted by Judge Kim Hornack, Third District Juvenile Court. Richard Schwermer, Administrative Office of the Courts, responded to questions of committee members.

MOTION:    Rep. Romero moved to pass H.B. 249 out favorably. The motion passed unanimously with Rep. McGee absent for the vote.

Rep. Ferrin relinquished the chair to Rep. Hutchings.





H.B. 88    Grand Jury Amendments (Rep. C. Oda)


MOTION:    Rep. Ferrin moved to return H.B. 88 to the Rules Committee for interim study. The motion passed unanimously with Rep. McGee absent for the vote.


H.B. 254    Child Care Licensing Restrictions (Rep. M. S. Lawrence)

MOTION:    Rep. Lawrence moved to delete in title and body H.B. 254 and replace it with 1st Substitute H.B. 254. The motion passed unanimously with Rep. McGee absent for the vote.

Rep. Lawrence introduced 1st Substitute H.B. 254 and explained it to the committee, assisted by Dr. Mark Babitz, Child Care Licensing, Department of Health.

MOTION:    Rep. Hendrickson moved to pass 1st Substitute H.B. 254 out favorably. The motion passed unanimously with Rep. McGee absent for the vote.


H.B. 223    Trespass Law Amendments (Rep. K. Gibson)

Rep. Gibson introduced H.B. 223 and explained it to the committee, assisted by Bud Cox, Davis County Sheriff and president of Utah Sheriffs Association.

Spoke in favor of the bill:    Art Haney, Weber County Sheriff's Office, representing the Law Enforcement Legislative Committee

MOTION:    Rep. Ferrin moved to proceed to the next item on the agenda. The motion passed unanimously with Rep. McGee absent for the vote.


H.B. 227    Underage Tattooing Penalty Amendment (Rep. D. Ure)

Rep. Ure introduced H.B. 227 and explained it to the committee.






MOTION:    Rep. Hogue moved to amend the bill as follows:

1.    Page 2, Line 56 through Page 3, Line 59 :    

             56          (5) (a) A person who violates Subsection (2) or (3) is guilty of a class [C] B
             57      misdemeanor.
             58          (b) The owner or operator of a business in which a violation of Subsection (2) or (3)
             59      occurs is subject to a civil penalty of
{   $750   }        $1,000       for each violation.


The motion to amend the bill passed unanimously with Rep. McGee absent for the vote.

MOTION:    Rep. Lawrence moved to pass the amended bill out favorably. The motion passed unanimously.

MOTION:    Rep. Hendrickson moved to adjourn the meeting. The motion passed unanimously.

Rep. Hutchings adjourned the meeting at 9:25 a.m.
