Rep. Lawrence called the meeting to order at 8:07 a.m.

MOTION:    Rep. Dee moved to approve the minutes of February 3, 2006. The motion passed unanimously, with Rep. Becker, Rep. Buxton, Rep. Gibson, Rep. King, Rep. Menlove, and Rep. Shurtliff absent for the vote.

H.B. 337    Education Resources Conservation Program (Rep. J. Biskupski)

Rep. Biskupski introduced and explained the bill to the Committee.

MOTION:    Rep. Dee moved to amend H.B. 337 as follows:

1.    Page 3, Lines 87 through 89 :    

             87          53A-1-1003. School districts and charter schools to implement resource
             88      conservation measures and management.
             89          (1) School districts and charter schools

2.    Page 4, Lines 100 through 102 :

The motion passed unanimously, with Rep. Becker absent for the vote.

MOTION:    Rep. Shurtliff moved that the Committee recommend H.B. 337 favorably as amended. The motion passed unanimously.

H.B. 196    Real Property Disclosures (Rep. G. Hughes)

Rep. Hughes introduced and explained the bill to the Committee, with the help of Colonel Scott Olson, Installation Manager at Camp Williams.

MOTION:    Rep. Holdaway moved to amend H.B. 196 as follows:

1.    Page 1, Line 27 through Page 2, Line 29 :    

             27          (1) A
{   person   }        property owner of record adjacent to a military installation or a military installation       may record notice of the presence of a military installation on the record

             28      for a parcel of real property that abuts the military installation in the office of the county
             29      recorder for the county in which the property is located.

The motion passed, with Rep. Gibson and Rep. Hardy voting in opposition, and Rep. King and Rep. Menlove absent for the vote.

MOTION:    Rep. Holdaway moved that the Committee recommend H.B. 196 favorably as amended. The motion passed, with Rep. Gibson voting in opposition, and Rep. King and Rep. Menlove absent for the vote.

Rep. Lawrence relinquished the chair to Rep. Dee.

1st Sub. H.B. 319 Density Credit for Land Donated to School District (Rep. D. Cox)

Rep. Cox introduced and explained the bill as amended to the Committee. Note: The House Political Subdivisions Standing Committee adopted the substitute bill and an amendment in its February 1, 2006 meeting.

MOTION:    Rep. Shurtliff moved that the Committee recommend 1st Sub. H.B. 319 favorably as amended. The motion passed unanimously, with Rep. Becker, Rep. King, and Rep. Menlove absent for the vote.

Rep. Dee relinquished the chair back to Rep. Lawrence.

H.B. 448    Standardizing Documents Filed with the County Recorder (Rep. C. Frank)

Rep. Frank introduced and explained the bill to the Committee, with the help of Brent Gardner, Utah Association of Counties.

MOTION:    Rep. Dee moved that the Committee go to the next item on the agenda. The motion passed unanimously, with Rep. Becker, Rep. King, and Rep. Menlove absent for the vote.

S.B. 101    County Assistance to Nonprofit Entities (Sen. D. Thomas) (Rep. B. Dee)

Sen. Thomas introduced and explained the bill to the Committee.

MOTION:    Rep. Gibson moved that the Committee recommend S.B. 101 favorably. The motion passed unanimously, with Rep. Becker and Rep. King absent for the vote.

MOTION:    Rep. Dee moved that S.B. 101 be placed on the Consent Calendar. The motion passed unanimously, with Rep. Becker and Rep. King absent for the vote.

S.B. 149    Providing for Indigent Defense (Sen. G. Bell) (Rep. Julie Fisher)

Sen. Bell introduced and explained the bill to the Committee.

MOTION:    Rep. Gibson moved that the Committee recommend S.B. 149 favorably. The motion passed unanimously, with Rep. Becker and Rep. Holdaway absent for the vote.

S.B. 117    Eminent Domain Amendments (Sen. H. Stephenson) (Rep. D. Ure)

This bill was not considered.



H.B. 292    Use of Eminent Domain (Rep. A. Tilton)

MOTION:     Rep. Dee moved that the Committee refer H.B. 292 back to the House Rules Committee. The motion passed unanimously, with Rep. Becker and Rep. Holdaway absent for the vote.

MOTION:    Rep. Dee moved to adjourn the meeting. The vote was unanimous. Rep. Lawrence adjourned the meeting at 9:48 a.m.
