Chair Jenkins called the meeting to order at 8:06 a.m., and announced that S.B. 42 Amendments Prohibiting Health Insurance Discrimination (S. McCoy) would not be heard and had been transferred to another committee.

Approval of Minutes

    MOTION:
Sen. Hellewell moved to approve the minutes of the January 26, 2006 meeting.

    The motion passed unanimously with Sens. Hickman, Mansell, Waddoups, Davis, and     Mayne absent for the vote.

1.    S.B. 114 Producer and Affiliate Disclosure Amendments
(B. Evans)
    
Sen. Evans introduced the bill and 1st Sub. S.B. 114 was distributed.

     MOTION: Sen. Hatch moved to adopt 1st Sub. S.B. 114.


    The motion passed unanimously with Sens. Hickman, Mansell, Waddoups, Davis, and     Mayne absent for the vote.

    Linn Baker, Dir., PEHP, clarified and spoke in support of the bill.

    Brian Allen, American Family Insurance, Liberty Mutual Insurance, spoke in support of the     bill.
    
     MOTION: Sen. Killpack moved to pass the substitute bill out favorably.

    The motion passed unanimously with Sens. Mansell, Davis, and Mayne absent for the vote.

2.    S.B. 68 Plumbing License Qualifications Amendments (P. Hellewell)
    
Sen. Hellewell introduced the bill and the following amendments were distributed:

1.    Page 1, Lines 14 through 17 :    

             14          .    provides that a licensed apprentice plumber shall be under the immediate
             15      supervision of a licensed journeyman plumber
{  and that a licensed residential

             16      apprentice plumber shall be under the supervision of a licensed journeyman
             17      plumber

    David Halverson, contractor, Chairman, State Plumbing Licensing Board, spoke in support     of the bill.     

    MOTION:
Sen. Hatch moved to pass the bill out favorably as amended.

    The motion passed unanimously.

3.    S.B. 165 Corporations - Professional Services Amendment
(L. Hillyard)
    
Sen. Hillyard introduced the bill and 1st Sub. S.B. 165 was distributed.

     MOTION: Sen. Killpack moved to adopt 1st Sub. S.B. 165.

    The motion passed unanimously with Sen. Mayne absent for the vote.

     MOTION: Sen. Mansell moved to pass the substitute bill out favorably.

    The motion passed unanimously with Sen. Mayne absent for the vote.

     MOTION: Sen. Hatch moved that the bill be placed on the Consent Calendar.

    The motion passed unanimously.

4.    S.B. 162 Department of Financial Institutions Enforcement of Applicable Law
    (L. Hillyard)

    Sen. Hillyard introduced the bill.


    Ed Leary, Commissioner, Utah Dept. of Financial Institutions, clarified and spoke in support     of the bill.

    Spencer Stokes, Utah League of Credit Unions, spoke to the bill.

     MOTION: Sen. Killpack moved to pass the bill out favorably.

    The motion passed unanimously.
    
5.    S. B. 116 Department of Financial Institution's Fees (L. Hillyard)
    Sen. Hillyard introduced the bill.

    Ed Leary, Commissioner, Utah Department of Financial Institutions, clarified the bill and     answered questions from the committee.

            Sen. Hickman declared a conflict of interest.

    Preston Jackson, Pres./CEO, Merrill Lynch Bank, USA, further clarified and spoke in support     of the bill.

             Lynn Kuehne, Exec. Vice Pres., Utah League of Credit Unions, spoke to the bill.

     MOTION: Sen. Hatch moved to pass the bill out favorably.

    The motion passed unanimously.

     MOTION: Sen. Waddoups moved to adjourn.

    The motion passed unanimously. Chair Jenkins adjourned the meeting at 9:25 a.m.
